1 <br /> SECTION 5. Based on the entire record before the City Council and all written and oral <br /> 2 evidence presented, the Planning Commission finds that: (i) the economic interests of Colton <br /> citizens and the public health, safety and welfare will be best served by entering into the Second <br /> 3 Amendment; (ii) this Second Amendment is compatible with the uses authorized in, and the <br /> regulations prescribed for, the area in which the Property is located; (iii) the Second Amendment is <br /> 4 in conformity with the public convenience, general welfare and good land use practice; and (iv) the <br /> Second Amendment will not adversely affect the orderly development or the preservation of <br /> 5 property values for the property it governs or any other property. <br /> 6 The City Council further finds that among the public benefits to accrue to the residents of the City as <br /> a result of the Second Amendment include: (a) Dedication and improvements to three (3) local <br /> 7 parks; and (b) annexing the project site into the City's Maintenance and Public Safety Community <br /> Facilities Districts. <br /> 8 <br /> SECTION 6. Pursuant to California Government Code Section 65865, the Planning <br /> 9 Commission hereby recommends to the City Council approval of the Second Amendment attached <br /> hereto as Exhibit "A", entitled "Second Amended and Restated Development Agreement between <br /> 10 City of Colton and Iron Horse Hills LLC, an Arizona limited liability company" (the "Development <br /> Agreement"). <br /> 11 <br /> SECTION 7. The City Clerk shall certify to the adoption of this Ordinance and shall cause <br /> 12 the same to be posted as required by law.
