1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />181' <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />verbal evidence presented, the City Council finds this Text Amendment is reasonably <br />related to the public welfare of the citizens of the City of Colton and the surrounding <br />region because it encourages the rehabilitation and preservation of housing, including low <br />income housing, in a manner that does not adversely affect the welfare of the citizens of <br />the City of Colton and the surrounding region. <br />SECTION 2: Section 18.46.070 is hereby added to the Colton Municipal Code to <br />read as follows: <br />"18.46.070 Continuation of nonconforming structures used for residential <br />purposes. <br />A. Notwithstanding any provision to the contrary in this chapter, <br />nonconforming structures used for residential purposes or a nonconforming structure and <br />premises in combination used for residential purposes and which were otherwise lawful <br />prior to the zoning amendment categorizing it nonconforming may be continued to be <br />used for residential purposes for a specified period of time subject to the approval of a <br />Nonconforming Extension, notwithstanding their discontinuation or abandonment. <br />B. Approval or denial of a Nonconforming Extension to continue the use of <br />an abandoned or discontinued nonconforming residential structure shall be subject to the <br />provisions of subsection C. An extension of up to 3 years may be granted, subject to the <br />approval of a Nonconforming Extension. <br />C. The Design Review Committee shall make the following findings before <br />granting a Nonconforming Extension to extend and continue the use of an abandoned or <br />discontinued nonconforming residential structure: <br />1. The nonconforming structure used for residential purposes or <br />nonconforming structures and premises in combination used for residential purposes is <br />not being enlarged or extended in such a way as to occupy any part of the structure or <br />structure and premises in combination that it did not occupy on the effective date that it <br />became nonconforming. <br />2. The nonconforming structure used for residential purposes or <br />nonconforming structure and premises in combination used for residential purposes <br />
