Staff Report to the Mayor and City Council <br />Appeal of Modification of Zoning Entitlement - Ecology Recycling Services <br />June 4, 2024 <br />Page 6 <br /> <br /> <br /> <br />The City Council has the option to uphold the Planning Commission’s decision as contained in <br />the attached City Council Resolution No. R-37-24 (Attachment 6), or <br /> <br />The City Council has an option to overturn the Planning Commission’s Decision the decision of <br />the Planning Commission as related to the request by the Appellant to modify Condition of <br />Approval #11 to allow all materials to be processed or stored on the project site shall not exceed <br />a stacking height of 35-feet or other height as determined by the City Council. Staff will need to <br />return with a final resolution including findings for approval, which will be provided by staff <br />after hearing the discussion and reasons why the Council may overturn the Planning <br />Commission’s decision (Attachment 7, Resolution No. R-38-24). <br /> <br />FISCAL IMPACTS <br /> <br />None. <br /> <br />ALTERNATIVES <br /> <br />• Deny Appeal and uphold Planning Commission decision; or <br /> <br />• Grant Appeal overturning the Planning Commission Decision related to Condition No., <br />11 to allow change in storage pile height for the site; or <br /> <br />• Provide alternative direction to staff. <br /> <br />ATTACHMENT <br />1.
