1 <br /> 2 RESOLUTION NO . 4608 <br /> 3 RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF COLTON AMENDING RULE XI , SECTION <br /> 4 4A, OF RESOLUTION NO . 2240 , PERSONNEL RULES <br /> AND REGULATIONS FOR THE CITY OF COLTON. <br /> 5 <br /> 6 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLTON <br /> 7 AS FOLLOWS : <br /> 8 1 . RULE XI — ATTENDANCE AND LEAVES , is hereby amended to <br /> 9 read as follows : <br /> 10 Section 4a . Accumulated Sick Leave at Termination of <br /> 11 Employee <br /> 12 Except as otherwise herein stated , accumulated sick leave is lost <br /> 13 when the employee is terminated. In no event shall employees who <br /> 14 have not worked for the City as regular salaried employees for more <br /> 15 than five years be entitled to use sick leave to defer termination <br /> 16 of their employment by the City nor shall they be compensated for <br /> 17 sick leave upon such termination for any reason including but not <br /> 18 limited to retirement . An employee who is permanently disabled <br /> 19 from performing the duties of the position shall be retired upon <br /> 20 that fact being established . In the event such employee applies <br /> 21 for and consents to such retirement , then upon the retirement <br /> 22 being accomplished , the employee shall be compensated for his <br /> 23 accumulated unused sick leave ( if and only if he has five years of <br /> 24 regular paid City service) by payment in a lump sum. That sum is <br /> 25 determined as follows : <br /> 26 The number of hours of sick leave accrued , multiplied by his <br /> 27 hourly rate earnings at the time of termination multiplied <br /> 28 <br /> 1 <br />
