FRASER, DIRECTOR OF WATER & WASTEWATER OPERATIONS <br />SUBJECT: AWARD OF BIDS TO FURNISH MATERIALS REQUIRED FOR MT. VERNON <br />AVENUE AND E. LAUREL STREET MAINLINE REPLACEMENT PROJECTS <br />TO INLAND WATER WORKS IN THE AMOUNT OF $47,010.52 FOR THE E. <br />LAUREL STREET IMPROVEMENTS AND $77,057.25 FOR THE MT. <br />VERNON AVENUE IMPROVEMENTS. <br />DATE: JANUARY 12, 2006 <br />BACKGROUND: <br />The City of Colton has old steel water mains that are over 50 years old. The old steel pipes are corroded, <br />causing leaks and discolored water to our customers. <br />DISC USSION/ANALYSIS: <br />To correct the problem of the discolored water and leaks in the old steel pipes, a Mainline Replacement <br />Program was implemented. Currently, pipeline replacement projects are underway in the western zone of <br />Colton where the steel pipes are over 50 years old. To date, the City's Water Division has replaced 20,243 <br />feet of 6" old steel pipe with 8" Polyvinyl Chloride (PVC) pipe as wetl as adding new fire hydrants and <br />appurtenances. <br />In accordance with the City's Purchasing Policy, requests for Sealed Bids were sent to National Water <br />Works, Inland Water Works, Western Water Works and S & J Supply Company for the necessary piping and <br />appurtenances for Mt. Vernon and E. Laurel Street to replace approximately 3,400 feet of the old steel pipes. <br />Sealed bids were opened at the Corporate Yard Conference Room on Wednesday, January 11, 2006 at <br />3:00 p.m. Inland Water Works was the low bidder in the amount of $47,010.52 for E. Laurel Street Project. <br />Inland Water Works was also the low bidder in the amount of $77,057.25 for Mt. Vernon Avenue Project. <br />Although Western Water works was the apparent lowest bidder on the Mt. Vernon Avenue Project (Attached <br />Bid Analysis), their bid was considered non-responsive due to a clerical error in their bid sheet (they failed to <br />multiply a per unit price by 100 feet in each unit). State law requires the City to reject a bid as non-responsive <br />when an error in the bid affects the amount of the bid or creates an unfair advantage for the bidder. Case law <br />further provides that such a situation occurs when there is a clerical error in the bid that would be sufficient to <br />allow the bidder to request relief under the Public Contract Code. By analogy, such a situation is present with <br />the bid of Western Water Works. <br />FINANCIAL IMPACT: <br />Sufficient funds are available in Capital Improvement Account Numbers 521-8100-8106-3890-0000-000, <br />521-8111-8106-3890-0000-000 and 521-8117-8106-3890-0000-000. <br />ENVIRONMENTAL IMPACT: <br />None <br />CONFLICT OF INTEREST — Gift Disclosure Requirements <br />Agenda January 17, 2006 <br />Updated 1-13-2006 <br />
