CITY OF COLTON AGENDA REPORT FOR THE COLTON UTILITY AUTHORITY MEETING OF FEBRUARY 21, 2006 TO: HONORABLE CHAIRPERSON AND UTILITY AUTHORITY MEMBERS FROM: ERIC R. FRASER, DIRECTOR OF WATER & WASTEWATER OPERATIONS SUBJECT: APPROVE AND ADOPT A RESOLUTION TO ACCEPT THE TERMS OF TF UPPER SANTA ANA WATER RESOURCES ASSOCIATION AND ASSIGN VOTING MEMBER AND AN ALTERNATE. DATE: FEBRUARY 21, 2006 BACKGROUND: The City of Colton has participated in the Upper Santa Ana Water Resources Association over 10 years, but has never had anyone officially appointed as a "Regular Member". DISCUSSION/ANALYSIS: The Upper Santa Ana Water Resources Association was formed to take a leadership role in managing ground water and surface water resources in the Upper Santa Ana River Watershed. The City of Colton has never had a "Regular Member' in this association and has been unable to have any voting rights. A "Regular Member' must be a municipality, public water company, mutual water company, irrigation district, conservation district, municipal water district, a county flood control district or county water district that is participating or has participated in artificial recharge of, production from or surface water diversions from the Upper Santa Ana River Watershed. In order to be considered a "Regular Member,' an organization must provide an authorizing resolution or letter from its respective governing body accepting the terms and conditions of membership, must pay any dues, fees or costs assessed in a timely fashion, must attend meetings of the association on a regular basis, and must cooperate in attaining the purpose of the Association. FINANCIAL IMPACT: There are no fees at this time although the Association may implement fees at a later date. There are sufficient funds in Account Number 521-8300-8300-2270 if such fees are implemented. ENVIRONMENTAL IMPACT: None CONFLICT OF INTEREST — Gift Disclosure Requirements None RECOMMENDATION: The City of Colton meets these requirements and Staff recommends that the Colton Utility Authority approve and adopt a Resolution to accept the terms of the Upper Santa Ana Water Resources Association and assign the Director of Water and Wastewater as the "Regular Member' with voting rights and the Water Utility Manager as an alternate.
