CITY OF COLTON <br />AGENDA REPORT <br />FOR THE COLTON UTILITY AUTHORITY MEETING OF FEBRUARY 21, 2006 <br />TO: HONORABLE CHAIRPERSON AND UTILITY AUTHORITY MEMBERS <br />FROM: ERIC R. FRASER, DIRECTOR OF WATER & WASTEWATER OPERATIONS <br />SUBJECT: APPROVE AND ADOPT A RESOLUTION TO ACCEPT THE TERMS OF TF <br />UPPER SANTA ANA WATER RESOURCES ASSOCIATION AND ASSIGN <br />VOTING MEMBER AND AN ALTERNATE. <br />DATE: FEBRUARY 21, 2006 <br />BACKGROUND: <br />The City of Colton has participated in the Upper Santa Ana Water Resources Association over 10 years, but <br />has never had anyone officially appointed as a "Regular Member". <br />DISCUSSION/ANALYSIS: <br />The Upper Santa Ana Water Resources Association was formed to take a leadership role in managing ground <br />water and surface water resources in the Upper Santa Ana River Watershed. The City of Colton has never <br />had a "Regular Member' in this association and has been unable to have any voting rights. A "Regular <br />Member' must be a municipality, public water company, mutual water company, irrigation district, conservation <br />district, municipal water district, a county flood control district or county water district that is participating or has <br />participated in artificial recharge of, production from or surface water diversions from the Upper Santa Ana <br />River Watershed. In order to be considered a "Regular Member,' an organization must provide an authorizing <br />resolution or letter from its respective governing body accepting the terms and conditions of membership, must <br />pay any dues, fees or costs assessed in a timely fashion, must attend meetings of the association on a regular <br />basis, and must cooperate in attaining the purpose of the Association. <br />FINANCIAL IMPACT: <br />There are no fees at this time although the Association may implement fees at a later date. There are <br />sufficient funds in Account Number 521-8300-8300-2270 if such fees are implemented. <br />ENVIRONMENTAL IMPACT: <br />None <br />CONFLICT OF INTEREST — Gift Disclosure Requirements <br />None <br />RECOMMENDATION: <br />The City of Colton meets these requirements and Staff recommends that the Colton Utility Authority approve <br />and adopt a Resolution to accept the terms of the Upper Santa Ana Water Resources Association and assign <br />the Director of Water and Wastewater as the "Regular Member' with voting rights and the Water Utility <br />Manager as an alternate. <br />
