1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />19 <br />20 <br />21 <br />22 <br />23 <br />"Etching tool" means an instrument, tool or device designed for commonly used for <br />marking, curing or defacing glass, and includes devices designed for marking surfaces and <br />capable of marking glass. <br />"Felt tip marker" means any indelible marker or similar implement with a tip, which, at <br />its broadest width, is greater than one-eighth inch, containing ink that is not water-soluble. <br />"Graffiti" means any inscription, word, figure, symbol, mark, or design that is written, <br />marked, etched, scratched, drawn, inscribed, posted, painted or otherwise marked or affixed, <br />including but not limited to stickers, on any public or private real or personal property such <br />that it is visible from any public right of way or other property. <br />"Graffiti implement" means any aerosol paint container, etching cream, an etching <br />tool, a felt tip marker, graffiti stick, or gum label designed for or capable of defacing a <br />surface. <br />"Graffiti stick" means a device containing a solid form of paint, chalk, wax, epoxy or <br />similar substance designed for or capable of being applied to a surface by pressure, and <br />upon application, leaving a mark at least one-eighth of an inch in width and not water soluble. <br />age. <br />"Minor' means any unemancipated person who is less than eighteen (18) years of <br />"Person" means an individual or firm, partnership, corporation or similar organization. <br />"Responsible Party" includes the record owner of public or private property (excluding <br />property owned by the City) or property owned by public utilities or railroad corporations <br />located within the City; a person with primary responsibility for control of such public or <br />private property; and any person with primary responsibility for the maintenance of such <br />public or private property. <br />9.27.030 Defacement of public or private property; Declaration of nuisance. <br />A. It is unlawful for any person to maliciously write, paint, spray, scratch or <br />otherwise affix or apply graffiti on or in any public or private real or personal property, or any <br />structure or component thereof within the City. <br />B. Any graffiti placed or existing upon public or private property located within the <br />City is declared to be a public nuisance. Graffiti not voluntarily removed as provided in this <br />chapter may be abated as provided herein. <br />9.27.040 Possession of graffiti implement - Minors. <br />A. It is unlawful for a minor to possess any graffiti implement while upon public <br />property, in a public right of way, or near any type of public infrastructure, except as may be <br />authorized by the City. <br />B. It is unlawful for a minor to possess any graffiti implement while upon private <br />property, except as may be authorized by the property owner. <br />
