CITY OF COLTON <br />For the City Council Meeting of <br />March 21, 2006 <br />TO: Honorable Mayor and Council Members <br />FROM: Mark Nuaimi, Assistant City Manager <br />SUBJECT: Island Annexation Update <br />DATE: March 14, 2006 <br />BACKGROUND <br />On January 1, 2005, the unincorporated island annexation legislation became effective. The bill <br />was authored by Senator Torlakson (Senate Bill No. 1266) and signed into law by the Governor. <br />The legislation revised the language in Government Code Section 56375 pertaining to <br />annexation of existing islands of territory. The special provisions permit cities throughout the <br />State of California to annex islands of unincorporated territory that are substantially or totally <br />surrounded by a city's corporate boundaries that meet the following criteria: <br />The area must be 150 acres or less in size and that area constitutes the <br />entire island; <br />• The area constitutes an entire unincorporated island located within the <br />limits of a city, or constitutes a reorganization containing a number of individual <br />unincorporated islands; <br />• The area must be substantially or totally surrounded by the annexing city; <br />• The area must be developed or developing; <br />• The area does not contain prime agricultural land; <br />• The area will benefit from the annexation or is receiving benefits from <br />the annexing city. <br />The revised island annexation provisions will sunset on January 1, 2007; therefore, any city <br />desiring to take advantage of these special provisions must do so prior to this date. After <br />2007, state law reverts to the former island annexation provisions, which mandates that the <br />island annexation area must be 75 acres or less, cannot be attached to an unincorporated area <br />that is more than 100 acres, and is subject to written protest. <br />In light of the legislative changes, the San Bernardino Local Agency Formation Commission <br />(LAFCO) revised its annexation policy on March 31, 2005 pertaining to unincorporated islands <br />of territory.
