CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF March 21, 2006 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: ALAN SORK, FIRE MARSHAL <br />SUBJECT: APPROVAL OF ORDINANCE AMENDING CHAPTER 6.32 OF THE <br />COLTON MUNICIPAL CODE RELATING TO FIREWORKS <br />DATE: March 7, 2006 <br />BACKGROUND: <br />Chapter 6.32 of the Colton Municipal Code contains provisions which regulate the sale and use of <br />"safe and sane" fireworks. The City wishes to amend certain sections of Chapter 6.32 to: (1) <br />clarify the definition of "youth group"; (2) amend the requirements for allocating licenses for sales <br />of fireworks to increase the total number of licenses from fourteen (14) to fifteen (15); and (3) <br />require the temporary stands for fireworks sales to be constructed out of metal or synthetic <br />materials. <br />DISCUSSION/ANALYSIS: <br />In order to prepare for the upcoming Fourth of July holiday, Staff has prepared an ordinance to <br />amend the Colton Municipal Code regarding the sale of fireworks. <br />The proposed ordinance will make the following amendments to the Colton Municipal Code: <br />(1) Clarify the definition of youth group to remove the existing requirement that such groups <br />receive no public funding. <br />(2) Allow the City to issue one additional license to a youth organization, bringing the total of <br />annual licenses issued to fifteen (15). <br />(3) Expand the requirements for the temporary stand to require licensees to have stands <br />constructed of metal or synthetic materials of demonstrated low flammability and metal <br />flooring. <br />FINANCIAL IMPACT: <br />Not applicable. <br />ENVIRONMENTAL IMPACT: <br />Adoption of the proposed ordinance would have a beneficial environmental impact by reducing the <br />risk of fire hazard posed by the currently allowed temporary fireworks stands. <br />ITEM #5 <br />
