ZAMORA, DIRECTOR OF COMMUNITY <br />DEVELOPMENT <br />SUBJECT: REPORT ON ACTIONS TAKEN IN RESPONSE TO CITY <br />COUNCIL ADOPTION OF URGENCY ORDINANCE NO. NO. 0- <br />08-06 — AN URGENCY ORDINANCE OF THE CITY COUNCIL <br />OF THE CITY OF COLTON ENACTING A MORATORIUM ON <br />APPROVING APPLICATIONS FOR CERTAIN LAND USES <br />CITY-WIDE <br />DATE: APRIL 11, 2006 <br />BACKGROUND: <br />On March 21, 2006 the City Council adopted Urgency Ordinance No. 0-08-06, enacting a <br />moratorium on the approval of certain land uses city-wide ("Moratorium Ordinance"). These land <br />uses included the following: animal boarding, automobile storage, miniwarehouses, nightclubs, <br />private bus terminals, tattoo/body piercing, tobacco/hookah bars, marijuana dispensaries and swap <br />meets. <br />The Moratorium Ordinance was adopted to protect the public health, safety and welfare. The <br />reasons for the adoption of the Moratorium Ordinance are included in Section 1 of the Moratorium <br />Ordinance (Attached). <br />California Government Code Section, 65858(d) provides that ten days prior to the expiration of an <br />interim ordinance or any extension, the legislative body shall issue a report describing the measures <br />taken to alleviate the condition which led to the adoption of the ordinance. The purpose of this <br />agenda report is to report on those actions. <br />ANALYSIS/DISCUSSION: <br />As you know, the City has contracted with P&D Consultants to undertake a comprehensive <br />amendment to the City's General Plan and Zoning Ordinance. The consultants are at the stage <br />where they are analyzing data for the development of recommendations for proposed development <br />scenarios and proposed land uses. The Moratorium Ordinance was adopted because the City <br />Council was concerned that approval of additional land uses that have intense and unusual <br />development characteristics and operating features would adversely affect the public health, safety <br />ORANGEW W 21269.1 <br />
