ITEM #20
CITY OF COLTON
AGENDA REPORT
FOR THE COUNCIL MEETING OF APRIL 18, 2006
TO: HONORABLE MAYOR AND CITY COUNCIL
FROM: DAVID R. ZAMORA, DIRECTOR OF COMMUNITY
DEVELOPMENT
SUBJECT: REPORT ON ACTIONS TAKEN IN RESPONSE TO CITY
COUNCIL ADOPTION OF URGENCY ORDINANCE NO. NO. 0-
08-06 — AN URGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF COLTON ENACTING A MORATORIUM ON
APPROVING APPLICATIONS FOR CERTAIN LAND USES
CITY-WIDE
DATE: APRIL 11, 2006
BACKGROUND:
On March 21, 2006 the City Council adopted Urgency Ordinance No. 0-08-06, enacting a
moratorium on the approval of certain land uses city-wide ("Moratorium Ordinance"). These land
uses included the following: animal boarding, automobile storage, miniwarehouses, nightclubs,
private bus terminals, tattoo/body piercing, tobacco/hookah bars, marijuana dispensaries and swap
meets.
The Moratorium Ordinance was adopted to protect the public health, safety and welfare. The
reasons for the adoption of the Moratorium Ordinance are included in Section 1 of the Moratorium
Ordinance (Attached).
California Government Code Section, 65858(d) provides that ten days prior to the expiration of an
interim ordinance or any extension, the legislative body shall issue a report describing the measures
taken to alleviate the condition which led to the adoption of the ordinance. The purpose of this
agenda report is to report on those actions.
ANALYSIS/DISCUSSION:
As you know, the City has contracted with P&D Consultants to undertake a comprehensive
amendment to the City's General Plan and Zoning Ordinance. The consultants are at the stage
where they are analyzing data for the development of recommendations for proposed development
scenarios and proposed land uses. The Moratorium Ordinance was adopted because the City
Council was concerned that approval of additional land uses that have intense and unusual
development characteristics and operating features would adversely affect the public health, safety
ORANGEW W 21269.1
