CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF MAY 2, 2006 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Mark Nuaimi, Assistant City Manager <br />SUBJECT: Award of Contract to TMG Communications, Inc. <br />DATE: April 24, 2006 <br />BACKGROUND: <br />At the March 21, 2006 City Council meeting, the Mayor and City Council approved the initiation of <br />an island annexation program. A component of this island annexation program included the <br />implementation of a Public Education and Community Outreach program to residents in the <br />unincorporated area of Colton who would be annexed into the city through these efforts. This item <br />award)the contract for this Public Education and Community Outreach Program to TMG <br />Communications, Inc. <br />DISCUSSION/ANALYSIS: <br />Staff is prepared to move forward with the Public Education and Community Outreach Program to <br />satisfy the requirements of the Local Agency Formation Commission (LAFCO). Several other <br />local communities (Fontana & San Bernardino) have either completed or are in the process of <br />initiating their outreach activity. <br />Colton Municipal Code Section 3.08.140(C) authorizes the city council, in limited circumstances, to <br />award a professional services agreement to a consultant without a formal or informal RFP <br />process. Section 3.08.140(C) provides that competitive bidding, either formal or informal, is not <br />required "When the authorized contracting party determines that a competitive bid procedure has <br />been conducted by another public agency (e.g. through CMAS or GSA) and the price to the city is <br />equal to or better than the price to that public agency." In this situation, the City of Fontana <br />conducted an informal RFP process, soliciting responses from three bidders and selected TMG <br />Communications Inc. to conduct their Public Education campaign. The City of San Bernardino <br />also has selected TMG Communications, Inc. to conduct their Public Education campaign. <br />Staff believes that TMG Communications Inc. has demonstrated a clear competency to conduct a <br />Public Education campaign targeted to Island Annexation areas. The program they have <br />implemented elsewhere has proven quite effective at addressing the requirements of LAFCO and <br />addressing the concerns of the impacted residents. <br />FINANCIAL IMPACT: <br />Funding was allocated to the Island Annexation Application Account 100-1000-1180-2408-0000- <br />000. The cost of this activity ($27,273) is within the $30,000 allocated for the Public Education <br />campaign. <br />
