NOW, THEREFORE, the parties hereto agree as follows. <br />1. CITY shall do the following: <br />a. Establish a reimbursement district for parcels which <br />benefit from the water and sewer lines as shown on <br />Exhibit "A". <br />b. Establish connection fees for parcels shown in Exhibit <br />"A" of $30.60 per front foot for water and $30.30 per <br />front foot for sewer in addition to other fees and <br />administrative charges required by the CITY. <br />c. Reimburse Beneficiary the fees collected under said <br />Resolution, less administrative charges, without cost <br />to CITY, and without payment of interest thereon for <br />a period of ten (10) years, and may be extended by <br />mutual agreement of the parties. <br />2 It is expressly understood and agreed that nothing in this Agreement <br />shall constitute a charge on the General Fund of CITY. Neither <br />Shadid Inc. nor any other person or instrumentality shall have by reason <br />of this Agreement, any claim or lien on the General Funds of CITY or any <br />special fund of CITY except as a special funds of CITY or any special <br />fund of CITY except as a special fund is herein provided in the amount <br />herein specified and limited for reimbursement of water and <br />sewer lines described in Exhibit "A". <br />2 <br />
