R-124 -06 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, CALLING UPON: (1) THE SAN <br />BERNARDINO COUNTY BOARD OF SUPERVISORS TO FINALIZE <br />AND EXECUTE THE TENTATIVE SETTLEMENT AGREEMENTS <br />WITH THE CITIES OF COLTON AND RIALTO, AND (2) THE <br />REGIONAL WATER QUALITY CONTROL BOARD, SANTA ANA <br />REGION TO ASSIST THOSE CITIES TO RECOVER CLEAN-UP <br />COSTS FROM THE CORPORATE AND OTHER ENTITIES <br />RESPONSIBLE FOR POLLUTING THE RIALTO/COLTON <br />GROUNDWATER BASIN <br />WHEREAS, the City of Colton is responsible for supplying a safe, affordable <br />and reliable drinking water source to its residential and commercial customers; and <br />WHEREAS, the City owns and possesses valuable water rights in the <br />Rialto/Colton Groundwater Basin and relies on this aquifer to meet its needs for water; and <br />WHEREAS, a clean groundwater supply is essential to the welfare and vitality <br />of the City and the health and wellbeing of the public; and <br />WHEREAS, perchlorate is a chemical principally used to accelerate the <br />combustion of rocket fuels and propellants and in the manufacture of explosives, <br />munitions, flares, ordnance, and pyrotechnic products, such as fireworks; and <br />WHEREAS, perchlorate that is disposed of, discharged or released into the <br />environment is a hazardous substance within the definitions of the Comprehensive <br />Environmental Response, Compensation and Liability Act, as amended by the Superfund <br />Amendment and Reauthorization Act of 1986 (42 U.S.C. 9601, et seq.); the Resource <br />Conservation and Recovery Act of 1976 (42 U.S.C. 6901, et seq.); California Health and <br />Safety Code section 25300, et seq.; and the Porter -Cologne Water Quality Control Act, <br />California Water Code sections 13000, et seq.; and <br />1 <br />
