CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF SEPTEMBER 19, 2006 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: Community Development Department and City Attorney <br />SUBJECT: AN URGENCY ORDINANCE OF THE OF THE <br />CITY COUNCIL OF THE CITY OF COLTON IN <br />ACCORDANCE WITH GOVERNMENT CODE <br />SECTION 65858 ENACTING FOR A PERIOD <br />OF FORTY-FIVE (45) DAYS A MORATORIUM <br />ON THE APPROVAL OF LAND USE <br />ENTITLEMENTS AND PERMITS WITHIN AN <br />AREA NORTH OF 1-10, SOUTH OF SAN <br />BERNARDINO AVENUE, AND WEST OF <br />HERMOSA AVENUE TO THE WESTERLY CITY <br />LIMIT. <br />DATE: <br />BACKGROUND: <br />September 13, 2006 <br />On March 21, 2006, the City Council approved Urgency Ordinance No. 0-08-06. This urgency <br />ordinance authorized a moratorium on the approval of certain land uses city-wide. The City <br />Council was concerned that the continued approval of these land uses would be in conflict with <br />the City's on-going General Plan revision efforts. The types of land uses prohibited by the <br />moratorium included the following: <br />Animal Boarding <br />Private Bus Terminals <br />Automobile Storage <br />Tobacco/Hookah Bars <br />Mini Warehouses <br />Swap Meets (Indoor and Outdoor) <br />Nightclubs <br />Marijuana Dispensaries <br />Tattoo/Body Piercing <br />Subsequent to the adoption of this moratorium, City staff has received zoning inquiries and <br />application filings for certain additional land uses within the West Valley area that have intense <br />and unusual development and operating features. Staff is concerned that if such land uses <br />were approved, they could be incompatible with the recommendations from the EDSPAC <br />(Economic Development Strategic Planning Advisory Committee) and the City Councils' <br />expressed vision for these areas. Such land uses could also be incompatible with the <br />contemplated General Plan and zoning revisions, including changes in land use designations <br />
