10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Section 3 The City Council of the City of Colton does hereby determine that authorizing (1) <br />the joining of the Financing JPA, (2) the execution of the Joint Exercise of powers Agreement, <br />and (3) all steps that are reasonably convenient or necessary to join the Financing JPA, does <br />not constitute a project or projects under CEQA because: the proposed actions represent <br />administrative activities of the Valley District that will not result in direct or indirect physical <br />changes in the environment (Section 15378(b)(5) of the CEQA Guidelines); and it can be seen <br />with certainty that there is no possibility that the proposed action in question may have a <br />significant effect on the environment, and thus the proposed action in question may have a <br />significant effect on the environment, and thus the proposed action is not subject to CEQA <br />(Section 15061(b)(3) of the CEQA Guidelines). <br />Section 4 The Public Works Director is hereby appointed the initial representative of <br />Colton to serve on the board of directors of USARWIFIA and the Water/Wastewater Operations <br />Manager is hereby appointed the initial alternate to serve on the board of directors of <br />USARW I FA. <br />Section 5 The Mayor, City Manager, and any other proper officer of Colton, acting singly, <br />are each hereby authorized and directed to execute and deliver any and all documents and <br />instruments and to do and cause to be done any and all acts and things necessary or proper <br />for carrying out the transactions contemplated by the Joint Exercise of Powers Agreement. <br />Section 6 Unless otherwise defined herein, all terms used herein and not otherwise <br />defined shall have the meanings given such terms in the Joint Exercise of Powers Agreement <br />unless the context otherwise clearly requires. <br />Section 7 This resolution shall take effect immediately. <br />PASSED, APPROVED AND ADOPTED THIS 4T" DAY OF MARCH 2O25. <br />ATTEST: <br />kC T4 <br />Clerk <br />
