R-15-25 <br />RESOLUTION OF THE ACCEPTANCE OF A GRANT AWARD FROM <br />THE DEPARTMENT OF TOXIC SUBSTANCE CONTROL, AMENDING <br />THE FY 24/25 BUDGET INCREASING REVENUES AND <br />APPROPRIATIONS BY $272,000, AND AUTHORIZING THE CITY <br />MANAGER OR HIS DESIGNEE TO EXECUTE ALL GRANT <br />DOCUMENTS <br />WHEREAS, the City of Colton applied for funding to mitigate a land use covenant on city - <br />owned property, Assessor Parcel Number (APN) 163-041-38, located at 160 S. 10th Street in the <br />City's corporate yard; and <br />WHEREAS, on July 1, 2022, the Department of Toxic Substances Control (DTSC) notified the <br />City of Colton that it had been selected as the inaugural grantee for the Equitable Community <br />Revitalization Grant (ECRG) for $280,000; and <br />WHEREAS, on September 6, 2022, the City Council of the City of Colton approved Resolution <br />No. R-98-22, authorizing the acceptance of the initial $280,000 in funding; and <br />WHEREAS, a first amendment to the agreement was executed on June 11, 2024, extending the <br />agreement term to March 12, 2025; and <br />WHEREAS, a second amendment was executed on January 6, 2024, further extending the <br />agreement term to February 26, 2026; and <br />WHEREAS, a Supplemental Site Investigation (SSI) was conducted in August 2023 to address <br />data gaps related to historical site uses and PAH-impacted soil, with the SSI Report issued on <br />March 4, 2024; and <br />WHEREAS, based on the findings of the SSI, DTSC conditionally approved the SSI Addendum <br />Report on August 2, 2024, but requested additional delineation of tetrachloroethylene (PCE)- <br />impacted soil vapor and PAH-impacted soil; and <br />WHEREAS, the initial grant funds have been exhausted, leaving no remaining resources to <br />complete the additional site investigation; and <br />WHEREAS, on February 13, 2025, City staff submitted a request for a third amendment to the <br />ECRG agreement, seeking an additional $272,000 to complete the additional site investigation <br />as requested by DISC; and <br />WHEREAS, on March 6, 2025, the City was notified that its ECRG Third Amendment <br />Additional Funding Request was approved by DTSC, with an award of $272,000 in additional <br />funding to support the continued environmental investigation and mitigation activities; and <br />WHEREAS, the City is currently in the preconstruction design phase for a Zero Net Energy <br />(ZNE) Public Works and Utilities building at 160 S. 10th Street, and the results of the Phase II <br />Environmental Site Assessment will guide the removal of the land covenantor identify necessary <br />mitigation measures for the development of green space on the site. <br />
