1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 19 20 21 22 ORDINANCE NO. 0-04-25 AN ORDINANCE AMENDING TITLE 13, SECTION 13.04 OF THE COLTON MUNICIPAL CODE ESTABLISHING WATER CAPACITY CHARGES WHEREAS, the City Council of the City of Colton desires to amend certain provisions of the Colton Municipal Code to ensure consistency with legal requirements and industry standards; and WHEREAS, the City of Colton developed Water/Wastewater Capacity Fee in 2020 (Ordinance No. 0-02-20); and WHEREAS, the City has determined that, in order to adequately plan for new development and identify the public facilities and costs associated with mitigating the direct and cumulative impacts of new development, the City needs to update water capacity fees and adopt new capacity fees to fund future facilities, where appropriate; and WHEREAS, the City has conducted a Water Capacity Fee Study pursuant to the requirements of AB 1600 and Government Code section 66013 to address funding for future water facilities; and WHEREAS, all legal prerequisites to the adoption of the Ordinance have occurred. NOW, THEREFORE, the City Council of the City of Colton does ordain as follows: SECTION 1. Revocation of Water Capacity Fees. Any previous action, including any previously adopted resolution, ordinance, fee or charge, is hereby rescinded to the extent such previous action conflicts with the provisions herein. SECTION 2. Adoption of Water Capacity Fees. Water Fees, as identified in the chart below, are hereby adopted and supersede all fees. 1. Source; AWWA MI, Table 8-2.
