1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />19 <br />20 <br />21 <br />22 <br />ORDINANCE NO. 0-04-25 <br />AN ORDINANCE AMENDING TITLE 13, SECTION 13.04 OF THE <br />COLTON MUNICIPAL CODE ESTABLISHING WATER CAPACITY <br />CHARGES <br />WHEREAS, the City Council of the City of Colton desires to amend certain provisions of the <br />Colton Municipal Code to ensure consistency with legal requirements and industry standards; and <br />WHEREAS, the City of Colton developed Water/Wastewater Capacity Fee in 2020 (Ordinance <br />No. 0-02-20); and <br />WHEREAS, the City has determined that, in order to adequately plan for new development and <br />identify the public facilities and costs associated with mitigating the direct and cumulative <br />impacts of new development, the City needs to update water capacity fees and adopt new capacity <br />fees to fund future facilities, where appropriate; and <br />WHEREAS, the City has conducted a Water Capacity Fee Study pursuant to the requirements of <br />AB 1600 and Government Code section 66013 to address funding for future water facilities; and <br />WHEREAS, all legal prerequisites to the adoption of the Ordinance have occurred. <br />NOW, THEREFORE, the City Council of the City of Colton does ordain as follows: <br />SECTION 1. Revocation of Water Capacity Fees. Any previous action, including any <br />previously adopted resolution, ordinance, fee or charge, is hereby rescinded to the extent such <br />previous action conflicts with the provisions herein. <br />SECTION 2. Adoption of Water Capacity Fees. Water Fees, as identified in the chart below, <br />are hereby adopted and supersede all fees. <br />1. Source; AWWA MI, Table 8-2.
