Incorporation of Recitals. The City Council hereby finds <br />that all of the foregoing recitals presented herewith are true and correct and are <br />hereby incorporated and adopted as findings of the City Council. <br />SECTION 2. Amending Chapter 6.48 to the City's Municipal Code. <br />Chapter 6.48 of the City of Colton Municipal Code is hereby amended in its entirety <br />to read as follows: <br />"CHAPTER 6.48 — VERY HIGH FIRE HAZARD SEVERITY ZONES <br />6.48.010 — Adoption of LRA Fire Hazard Severity Zones Map <br />The City of Colton LRA Fire Hazard Severity Zones map (CALFIRE <br />March 24, 2025) is hereby adopted by the City for the purpose of identifying areas <br />within the Fire Hazard Severity Zones and for enforcement of the provisions of <br />Title 24 California Code of Regulations, California Building Code, Part 2, Chapter <br />7A, in all Very High Fire Hazard Severity Zones. 6.48.020 Fire Chief Authority; <br />Very High Fire Hazard Severity Zones. <br />The City Council hereby delegates authority to the City's Fire Chief to <br />designate future Very High Fire Hazard Severity Zones in the City, pursuant to <br />Government Code section 51175 et seq. and recommendations from CALFIRE." <br />SECTION 3. Posting. The City shall post a notice at the office of the San <br />Bernardino Recorder, San Bernardino County Assessor, and San Bernardino <br />County Planning Department identifying the location of the Very High Fire Hazard <br />Severity Zones in LRA map adopted pursuant to this Ordinance. <br />SECTION 4. Transmittal, The City shall transmit a copy of this Ordinance <br />to the State Board of Forestry and Fire Protection within 30 days of adoption. <br />SECTION 5. Severability. If any section, subsection, subdivision, <br />paragraph, sentence, clause or phrase of this ordinance, or any part thereof is for <br />any reason held to be unconstitutional, such decision shall not affect the validity of <br />the remaining portion of this ordinance or any part thereof. The City Council <br />hereby declares that it would have passed each section, subsection, subdivision, <br />paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one <br />or more section, subsection, subdivision, paragraph, sentence, clause or phrase be <br />declared unconstitutional. <br />SECTION 6. Compliance with California Environmental Quality Act. <br />Based on the entire record before the City Council, and all written and oral evidence <br />presented to the City Council, the City Council hereby finds that this ordinance is <br />exempt from review under the California Environmental Quality Act ("CEQA"), <br />pursuant to Sections 15060(c)(2) (the activity will not result in a direct or <br />reasonably foreseeable indirect physical change in the environment) and <br />
