As referenced above, the applicant will <br />pay for the increase to the contract. <br />ALTERNATIVES: <br />Reject staffs request for approval of the Second Amendment to the MBA Professional Services <br />Agreement for work that was required beyond the Scope of Work. However, such an action would <br />likely mean that the applicant would need to directly reimburse the additional environmental work <br />performed by the consultant. <br />FISCAL IMPACT: <br />None. The applicant (Pacific Rail Industries) will pay for all work required by the consultant for the <br />proposal, therefore, there is no cost to the City. <br />ENVIRONMENTAL IMPACT: <br />The consultant prepared the additional environmental work to address the order of the Court regarding <br />the previously approved Environmental Impact Report for the proposed modifications to the CUP. <br />CONFLICT OF INTEREST: <br />Michael Brandman Associates <br />Michael Brandman, President <br />Contact: Thomas F.
