As referenced above, the applicant will pay for the increase to the contract. ALTERNATIVES: Reject staffs request for approval of the Second Amendment to the MBA Professional Services Agreement for work that was required beyond the Scope of Work. However, such an action would likely mean that the applicant would need to directly reimburse the additional environmental work performed by the consultant. FISCAL IMPACT: None. The applicant (Pacific Rail Industries) will pay for all work required by the consultant for the proposal, therefore, there is no cost to the City. ENVIRONMENTAL IMPACT: The consultant prepared the additional environmental work to address the order of the Court regarding the previously approved Environmental Impact Report for the proposed modifications to the CUP.
