ITEM #16 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE COUNCIL MEETING OF NOVEMBER 7, 2006 <br />TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL <br />FROM: ERIC FRASER, WATER/WASTEWATER DIRECTOR <br />SUBJECT: RESOLUTION PROVIDING DIRECTION TO CITY STAFF <br />CONCERNING INTERPRETATION OF BIDDING AND <br />CONTRACTING PURCHASES AS APPLICABLE TO <br />SEWERIWATER LINE INSTALLATION PROJECTS <br />DATE: NOVEMBER 7, 2006 <br />BACKGROUND: <br />In 2005, the City Council passed a resolution authorizing City staff to interpret Section 3.08 <br />of the Colton Municipal Code ("Municipal Code") in such a manner as to allow the repair <br />and/or replacement of water and sewer pipelines on individual streets or related street <br />segments to be bid as individual projects. This determination made a significant difference <br />in the handling of these projects because the Municipal Code prohibits bid splitting. <br />Section 3.08.060(J) provides that "[T]he city shall not split a project, work, service or <br />purchase into smaller projects, works, services or purchases for the purpose of avoiding <br />any bidding or contracting requirements of this code." Accordingly, in its resolution, the <br />City Council cleared up the ambiguities in Section 3.08 relating to the repair and <br />replacement of individual sewer and/or water lines or segments of water and sewer lines, <br />and found that such activities were single projects. <br />As with the repair and replacement of these pipelines, City staff is eager to move forward <br />with the process of awarding contracts for new installations of individual sewer and/or <br />water lines. However, Section 3.08 of the Municipal Code is similarly unclear as to whether <br />the installation of new water and sewer pipelines on individual streets or related street <br />segments are single projects or whether the City's entire sewer and water pipeline system <br />constitutes a single project. As such, the City staff is once again asking for direction from <br />the City Council. <br />ANALYSIS: <br />Currently, the scope of installations of sewer and water pipelines on individual streets or <br />related street segments varies. The nature of the installation is dependent on the street or <br />related street segment's age, type, quality and length of the pipeline. Staff believes that in <br />order to address these individualized maintenance needs in the most efficient and cost- <br />
