R-60-23, R-73-23, R-15-24, R-16- <br />24, and R-17-24 and Ordinances Nos. 0-06-23 and 0-05-23; and <br />WHEREAS, in order to address the peremptory writ of mandate in Case No. <br />CIVSB2317228, the City prepared a revised 15183 Analysis, in accordance with the provisions of <br />the California Environmental Quality Act ("CEQA"); and <br />WHEREAS, Lineage Logistics is seeking City approval to allow for the construction of a <br />new warehouse/office buildings at 1400 Agua Mansa Road and developer IDI Logistics is seeking <br />City approval to allow for the construction and operation of a new warehouse/office buildings at <br />1500 Agua Mansa Road ("Project");and <br />WHEREAS, the City has revised its 15183 Analysis of the Project to address the <br />peremptory writ of mandate issued on November 19, 2025 by the San Bernardino Superior Court <br />related to operational air quality impacts, consistent with State CEQA Guidelines section 15183 <br />("Revised 15183 Analysis"), and found that it is in conformance with the analysis and conclusions <br />of the General Plan EIR, that there are no new significant off -site or cumulative impacts that were <br />not analyzed in the General Plan EIR, that there are no adverse impacts that are more severe than <br />those previously identified in the General Plan EIR.. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF COLTON: <br />SEC'.TION 1 _ <br />COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. <br />As a decision -making body for the Project, the City Council has reviewed and considered the <br />information contained in the Revised 15183 Analysis, comments received, and other documents <br />contained in the administrative record for the Project. Based on the City Council's independent <br />review and analysis it finds that the Revised 15183 Analysis and administrative record contain a <br />complete and accurate reporting of the environmental impacts associated with the Project, and that <br />the Revised 15183 Analysis has been completed in compliance with CEQA and the State CEQA <br />Guidelines. <br />SECTION 2. FINDINGS ON ENVIRONMENTAL IMPACTS. Based on the whole <br />record before it, including the Revised 15183 Analysis, the administrative record, and all other <br />written and oral evidence, the City Council finds that the Project will not have an adverse impact <br />on the environment. According to Section 15183(a) (Projects Consistent with a Community Plan <br />or Zoning), of the CEQA Guidelines, additional environmental review is not required for projects <br />"which are consistent with the development density established by existing zoning, community <br />plan, or general plan policies for which an EIR was certified," except as might be necessary to <br />determine whether there are project -specific significant effects. A Revised 15183 Analysis was <br />prepared to evaluate the proposed Project's consistency with the certified 2013 City General Plan <br />
