The City finds and determines that the foregoing recitals are true and correct. <br />SECTION 2. Pursuant to the Court Judgment and Peremptory Writ of Mandate in Case No. <br />CIVS132317228, the City Council hereby voids, vacates, and sets aside Resolution Nos. R-60-23, <br />R-73-23, R-15-24, R-16-24, and R-17-24, as well as Ordinances Nos. 0-06-23 And 0-05-23. <br />SECTION 3. Approval of this Resolution does not constitute a "project" under the <br />California Environmental Quality Act ("CEQA") pursuant to Public Resources Code section <br />21080(a) and State CEQA Guidelines section 15378 since approval of this Resolution does not <br />have the potential to result in either a direct physical change in the environment or a reasonably <br />foreseeable indirect physical change in the environment. Moreover, pursuant to CEQA Guidelines <br />section 15061(b)(3), the approval of this Resolution is exempt from CEQA because there is no <br />possibility that it may have a significant effect on the environment. <br />SECTION 4. The City Clerk shall certify to the adoption of this Resolution. <br />SECTION 5.
