DAP25-0047), Ordinance No. O-07-26. <br /> <br />Recommended Action: <br />Staff recommends that the City Council introduce for the first reading and pass by title only O- <br />07-26, An Ordinance of the City Council of the City of Colton Amending Title 18, Section <br />18.48.150 of the City of Colton Municipal Code Relating to Accessory Dwelling Units and <br />Junior Accessory Dwelling Units and Determining the Ordinance to be Exempt from CEQA. <br /> <br />Background: <br />Pursuant to the state planning and zoning law and the Colton Municipal Code, the Planning <br />Commission must consider the amendments, determine whether they are consistent with the <br />Colton General Plan and the existing Colton Zoning Code and make a recommendation to the <br />City Council. <br /> <br />In recent years, the California Legislature approved, and the Governor signed into law a number <br />of bills (“new ADU Laws”) that, among other things, amended Government Code section <br />65852.2 and 65852.22 to impose new limits on local authority to regulate ADUs and Junior <br />ADUs. In 2024, the California Legislature approved, and the Governor signed into law, two <br />new bills — AB 2533 and SB 1211 — that further amend state ADU law as summarized below. <br /> <br />At the January 13, 2026 and February 24, 2026 Planning Commission meeting, after its <br />discussions, the Commission voted 5-to-0 at both meetings recommending that the City Council <br />amend section 18.48.150 of the Colton Municipal Code relating to Accessory Dwelling Units <br />and Junior Accessory Dwelling Units and Determining the Ordinance to be exempt from the <br />California Environmental Quality Act (CEQA) (Attachment 1). <br />Page 9 of 597
