Finally, the SANBAG Nexus Study provides an estimate of the development impact fees to be <br />charged to developers to pay for anticipated fair share contributions for regional transportation <br />improvements for each local jurisdiction and or each jurisdiction's sphere area. San Bernardino <br />County has provided the estimates of project costs and growth in dwelling units/employment for <br />sphere areas, unless otherwise specified. The estimates are then used to calculate the development <br />impact fees that should be assessed against future development. The City Council approved <br />updated fees in August 2006. <br />ANALYSIS/DISCUSSION: <br />One of the requirements of the Development Mitigation Program approved by the San Bernardino <br />County Congestion Management Agency in November 2005 is an annual update of Nexus Study <br />project costs and fair share development contributions to these projects. The Development <br />Mitigation Nexus Study is scheduled to be updated in 2007. As part of the update, each local <br />jurisdiction has the opportunity to revise its cost estimates for arterial and grade separation projects. <br />Local agencies may choose one of two options when addressing cost escalation for this year: <br />1. Use 12.7%, which is the five-year rolling average of the Caltrans Highway Construction <br />Items Index. <br />2. Update project costs based on engineering estimates or another technically defensible <br />planning level study. Local jurisdictions would be required to demonstrate to SANBAG <br />staff that the estimates are reasonable and provide an accurate basis for cost escalation. <br />SANBAG has asked that each local jurisdiction send a letter to SANBAG indicating which <br />mechanism for cost escalation it will use for Calendar year 2006 by April 30, 2007. SANBAG staff <br />will make this request in a letter to City Managers as a part of the request for data on the 2007 <br />update of the Development Mitigation Nexus Study. For either scenario, local jurisdictions would <br />be required to revise their mitigation program by resolution to SANBAG by January 2, 2008. <br />City staff recommends using the 12.7% Caltrans Highway Construction Items Index as the cost <br />escalator in the update of the Development Mitigation Nexus Study. If the City were to undertake a <br />study, as suggested in the second option, staff anticipates the result will be comparable, if not equal <br />to, the Caltrans rolling average. <br />The City has until January 2008 to update the fees. Staff will bring the proposed updated fees back <br />to the City Council for approval in May or June 2007. <br />ENVIRONMENTAL IMPACT: <br />None. <br />CONFLICT OF INTEREST: <br />None. <br />
