PURPOSE <br />This MOU serves as an agreement between the Commission and Contractor for participation in <br />improving the quality of early learning, environments for young children through an investment by the <br />Commission for playground equipment to be provided to Contractor. In addition, it is the intention of <br />the Partner Agencies that the relationship solidified by this MOU will encourage a liaison to promote <br />activities for children prenatal through age five, while utilizing available resources. <br />Contractor will provide the following outcomes under this investment: <br />1. Increased engagement of parents and communities with early child development activities <br />2. Increased opportunities to discuss community needs and resources with the Commission <br />3. Demonstrated efforts to increase the capacity to serve children and to sustain operations through <br />leveraging, funds, resources, and support <br />4. Improve physical fitness among children <br />These outcomes are consistent with First 5 San Bernardino's Play Spaces for Children and <br />Community Engagement Strategy component. <br />II. TERM <br />A. This MOU is effective commencing March 7, 2007 and expires March 6, 2012. <br />B. This MOU may be terminated by either party by serving a written notice to the other parties. The <br />written notice must be given at least ninety days prior to the end of the fiscal year and shall be <br />effective only upon the first day of the succeeding fiscal year. <br />III. PARTNER AGENCIES' RESPONSIBILITIES <br />A. Contractor will be responsible for the following site work, and/or environment improvements to the <br />area where the playground equipment will be located: <br />• Perimeter fencing to secure playground equipment. <br />• Removal of five masonry pillars in outside playground area. <br />• Landscaping of playground area (i.e., grass, sprinklers) <br />B. Contractor will be responsible for keeping the area clean by cleaning and disinfecting the <br />playground equipment area for young children as per standards for California licensed child care <br />facilities. <br />C. Contractor assumes all responsibility for any and all injuries, illnesses, diseases or any other <br />unforeseeable events that may occur in the playground equipment area. <br />D. The playground equipment shall be maintained and operated at all times for the purpose of <br />providing the outcomes as set forth in Article I, above. <br />E. Contractor understands and acknowledges that the services under this MOU are for the purposes <br />of promoting, supporting and improving the early development and mental health of children ages <br />prenatal to 5. As such, services provided under this MOU shall offer a direct benefit to this <br />3 <br />
