PURPOSE This MOU serves as an agreement between the Commission and Contractor for participation in improving the quality of early learning, environments for young children through an investment by the Commission for playground equipment to be provided to Contractor. In addition, it is the intention of the Partner Agencies that the relationship solidified by this MOU will encourage a liaison to promote activities for children prenatal through age five, while utilizing available resources. Contractor will provide the following outcomes under this investment: 1. Increased engagement of parents and communities with early child development activities 2. Increased opportunities to discuss community needs and resources with the Commission 3. Demonstrated efforts to increase the capacity to serve children and to sustain operations through leveraging, funds, resources, and support 4. Improve physical fitness among children These outcomes are consistent with First 5 San Bernardino's Play Spaces for Children and Community Engagement Strategy component. II. TERM A. This MOU is effective commencing March 7, 2007 and expires March 6, 2012. B. This MOU may be terminated by either party by serving a written notice to the other parties. The written notice must be given at least ninety days prior to the end of the fiscal year and shall be effective only upon the first day of the succeeding fiscal year. III. PARTNER AGENCIES' RESPONSIBILITIES A. Contractor will be responsible for the following site work, and/or environment improvements to the area where the playground equipment will be located: • Perimeter fencing to secure playground equipment. • Removal of five masonry pillars in outside playground area. • Landscaping of playground area (i.e., grass, sprinklers) B. Contractor will be responsible for keeping the area clean by cleaning and disinfecting the playground equipment area for young children as per standards for California licensed child care facilities. C. Contractor assumes all responsibility for any and all injuries, illnesses, diseases or any other unforeseeable events that may occur in the playground equipment area. D. The playground equipment shall be maintained and operated at all times for the purpose of providing the outcomes as set forth in Article I, above. E. Contractor understands and acknowledges that the services under this MOU are for the purposes of promoting, supporting and improving the early development and mental health of children ages prenatal to 5.
