PARTIES AND DATE <br />This First Amendment to the Professional Services Agreement ("First Amendment") dated as <br />of the 7th day of June 2007 is entered into by and between the City of Colton ("City") and Krieger & <br />Stewart, Inc. ("Consultant") <br />ARTICLE 2. RECITALS <br />2.1 City and Consultant entered into that certain Professional Services Agreement dated <br />July 1, 2006 ("Agreement"), whereby Consultant agreed to provide Plan Check Services on the new <br />development tract projects. <br />2.2 City and Consultant now desire to amend the Agreement to increase the <br />compensation to include additional plan check services for the Herzig, Distinguished Homes and <br />Crystal Ridge Development Projects in an amount not -to -exceed $25,000 and to extend the term of <br />the agreement. <br />ARTICLE 3. TERMS <br />3.1 Section 3.1.2 Term is hereby modified and should read as follows: City is extending <br />the contract for an additional twelve (12) months through Fiscal Year Ending June 30, 2008. The <br />City may terminate this First Amendment to Professional Services Agreement at any time with or <br />without cause. If the City finds it necessary to terminate this Professional Services Agreement <br />without cause before Project completion, Consultant shall be entitled to be paid in full for those <br />Services adequately completed prior to the notification of termination. Consultant may terminate <br />this First Amendment to Professional Services Agreement for cause only. <br />RVPUB\NGS\635122 -1- <br />
