ORDINANCE NO. 0-06-07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, ESTABLISHING POLICIES REGARDING THE USE OF EMINENT DOMAIN FOR THE DOWNTOWN REDEVELOPMENT AREA PROJECT NO. I AND THE DOWNTOWN REDEVELOPMENT AREA PROJECT NO.2 AND AUTHORIZING RECORDING OF A REVISED STATEMENT OF PROCEEDINGS RECITALS A. In accordance with the provisions of the California Community Redevelopment Law (Health and Safety Code Sections 33000, et seq.), the City Council of the City of Colton, California ("City Council"), established the Redevelopment Agency for the City of Colton ("Agency"); B. Pursuant to Ordinance No. 1179 adopted on January 15, 1964, the City Council approved the Redevelopment Plan for the Downtown Redevelopment Area Project No. l; C. Pursuant to Ordinance No. 1263 adopted on January 18, 1966, the City Council approved the Redevelopment Plan for the Downtown Redevelopment Area Project No. 2; D. The Downtown Redevelopment Area Project No. 1 was amended on December 2, 1986 by Ordinance 0-16-86; E. The Downtown Redevelopment Area Project No. 2 was amended on December 2, 1986 by Ordinance 0-17-86; F. For purposes of this Ordinance, the Redevelopment Plan for the Downtown Redevelopment Project Area No. 1, as amended, and the Redevelopment Plan for the Downtown Redevelopment Project Area No. 2, as amended are, collectively, referred to as the "Redevelopment Plan." The lands subject to the Redevelopment Plan are referred to in this Ordinance as the "Project Area"; G. The Agency is engaged in activities necessary to execute and implement the Redevelopment Plan; H. Pursuant to new Health and Safety Code Section 33342.7, before July 1, 2007, the City Council is required to adopt an ordinance describing the Agency's eminent domain program ("Eminent Domain Program") under the Redevelopment Plan; I. Pursuant to new Health and Safety Code Section 33373 the Agency must record in the official records of the County of San Bernardino, California, a revised statement that proceedings for the redevelopment of the Project Area have been instituted ("Statement of Proceedings"), including a description of the lands subject to the Redevelopment Plan and describing the provisions of the Redevelopment Plan regarding exercise of the power of eminent domain; -I-
