ORDINANCE NO. 0-06-07 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF COLTON, CALIFORNIA, ESTABLISHING POLICIES <br />REGARDING THE USE OF EMINENT DOMAIN FOR <br />THE DOWNTOWN REDEVELOPMENT AREA PROJECT <br />NO. I AND THE DOWNTOWN REDEVELOPMENT AREA <br />PROJECT NO.2 AND AUTHORIZING RECORDING OF <br />A REVISED STATEMENT OF PROCEEDINGS <br />RECITALS <br />A. In accordance with the provisions of the California Community Redevelopment <br />Law (Health and Safety Code Sections 33000, et seq.), the City Council of the City of Colton, <br />California ("City Council"), established the Redevelopment Agency for the City of Colton <br />("Agency"); <br />B. Pursuant to Ordinance No. 1179 adopted on January 15, 1964, the City Council <br />approved the Redevelopment Plan for the Downtown Redevelopment Area Project No. l; <br />C. Pursuant to Ordinance No. 1263 adopted on January 18, 1966, the City Council <br />approved the Redevelopment Plan for the Downtown Redevelopment Area Project No. 2; <br />D. The Downtown Redevelopment Area Project No. 1 was amended on December 2, <br />1986 by Ordinance 0-16-86; <br />E. The Downtown Redevelopment Area Project No. 2 was amended on December 2, <br />1986 by Ordinance 0-17-86; <br />F. For purposes of this Ordinance, the Redevelopment Plan for the Downtown <br />Redevelopment Project Area No. 1, as amended, and the Redevelopment Plan for the Downtown <br />Redevelopment Project Area No. 2, as amended are, collectively, referred to as the <br />"Redevelopment Plan." The lands subject to the Redevelopment Plan are referred to in this <br />Ordinance as the "Project Area"; <br />G. The Agency is engaged in activities necessary to execute and implement the <br />Redevelopment Plan; <br />H. Pursuant to new Health and Safety Code Section 33342.7, before July 1, 2007, the <br />City Council is required to adopt an ordinance describing the Agency's eminent domain program <br />("Eminent Domain Program") under the Redevelopment Plan; <br />I. Pursuant to new Health and Safety Code Section 33373 the Agency must record <br />in the official records of the County of San Bernardino, California, a revised statement that <br />proceedings for the redevelopment of the Project Area have been instituted ("Statement of <br />Proceedings"), including a description of the lands subject to the Redevelopment Plan and <br />describing the provisions of the Redevelopment Plan regarding exercise of the power of eminent <br />domain; <br />-I- <br />
