PARTIES AND DATE <br />This First Amendment to the Construction Contract ("First Amendment") dated as <br />of the 8TH day of August, 2007 is entered into by and between the City of Colton <br />("City") and Harris Construction Engineering, Inc. ("Contractor"). <br />ARTICLE 2. RECITALS <br />2.1 City and Contractor entered into that certain Construction Agreement <br />dated June 9, 2007 ("Contract"), whereby Contractor agreed to provide trenching, <br />shoring, backfilling and paving services. <br />2.2 City and Contractor now desire to amend the Contract to increase the <br />amount of compensation by Thirty Three Thousand One Hundred Seventy Two Dollars <br />and Twenty Cents ($33,172.20). <br />ARTICLE 3. TERMS <br />3.1 Section 3.8.1 of the Contract is hereby deleted in its entirety and replaced <br />with a new Section 3.8.1 to read as follows: <br />3.8.1 Amount of Compensation. As consideration for performance of the Work <br />required herein, City agrees to pay Contractor the total contract price NOT TO EXCEED <br />FIFTY EIGHT THOUSAND ONE HUNDRED SEVENTY TWO DOLLARS AND <br />TWENTY CENTS ($58,172.20) (Total Contract Price) provided that such amount shall <br />be subj,ect to adjustment pursuant to the applicable terms of this Contract or written <br />change orders or amendments approved and signed in advance by the City. <br />3.2 Continuing Effect of Agreement. Except as amended by this First <br />Amendment, all provisions of the Contract shall remain unchanged and in full force and <br />effect.
