ITEM #2 <br />CITY OF COLTON <br />For the City Council Meeting of <br />September 4, 2007 <br />TO: Honorable Mayor and Councilmembers <br />FROM: Candace E. Cassel, Economic Development Direct <br />SUBJECT: Consideration and Approval of Extension of Urgency Ordinance No. 0- <br />17-06 and Urgency Ordinance No. 0-20-06 (West Valley Moratorium) on <br />the Approval of Land Use Entitlements and Permits within an Area <br />North of the 1-10, South of San Bernardino Avenue, and West of <br />Hermosa Avenue to the Westerly City Limit. <br />DATE: August 10, 2007 <br />BACKGROUND <br />On September 19, 2006, the City Council adopted Urgency Ordinance No. 0-17-06, effective for forty- <br />five (45) days, and on October 17, 2006, adopted an extension ordinance, 0-20-06, extending the <br />prohibition of the approval of land use entitlements and permits on property in the West Valley area of <br />the City ("West Valley Moratorium") an additional ten (10) months and fifteen (15) days, expiring on <br />September 19, 2007. The boundaries of the West Valley Moratorium generally include an area north <br />of the Interstate 10 freeway, south of San Bernardino Avenue and west of Hermosa Avenue to the <br />westerly City limits. <br />Pursuant to California Government Code Section 65858, the City Council adopted the moratorium, by <br />a 4/5ths vote, due to concerns that some land uses could be approved that would be incompatible <br />with the recommendation from the EDSPAC (Economic Development Strategic Planning Advisory <br />Committee) and the City's expressed land use vision for the West Valley area, which has since been <br />named the Colton Super Block. Such land uses would also be incompatible with the contemplated <br />General Plan and zoning revisions being considered including changes in land use designation and <br />General Plan goals and policies that attempt to mitigate the impacts of intense land uses on <br />surrounding properties. <br />The West Valley Moratorium is set to expire September 19, 2007. Section 65858(d) of the California <br />Government Code requires the legislative body issue a written report describing the measures taken <br />to alleviate the condition which led to the adoption of the ordinance ten days prior to the expiration of <br />the ordinance and its extension. The Report was made available to the public at the Council meeting <br />of August 21, 2007 (see attachment). Section 65858 of the Government Code also allows a <br />legislative body to extend a moratorium for an additional term of twelve (12) months. Thus, extension <br />of the West Valley Moratorium would be extended to September 19, 2008. <br />Section 65090 of the California Government Code requires the legislative body to notice and conduct <br />a public hearing.
