The scope of <br />services that will be provided by the Consultant allows Planning Staff the opportunity to respond to <br />other projects that are time sensitive. <br />Pursuant to Section 3.08.140 of the Colton Municipal Code, the City Manager has determined that <br />it is in the best interest of the city and its administrative operations to dispense with public bidding <br />for the following reasons: <br />1. As noted above, Mr. Morita has been providing environmental consulting services to the <br />department since 2004 and has become well acquainted with the city processes for project <br />delivery, claims processing, departmental operations, and other internal requirements; <br />2. Mr. Morita has accomplished prior assignments and services in a professional manner <br />completely satisfactory to the city; <br />3. Mr. Morita has provided consulting services and assistance to other city endeavors beyond <br />his original scope of work for the Community Development Department, such as (a) <br />assistance in the city's annexation efforts, (b) preparation of CEQA documentation for <br />other city departments, and (c) peer review of CEQA documents for projects where the <br />City of Colton is not the Lead Agency. <br />In addition to the above information, staff believes that the costs for services that will be provided <br />by Mr. Morita are a bargain when compared to the costs that are charged by other environmental <br />consulting firms. Based on a cursory review of environmental consultants that provide similar <br />services, the rates on a per hour basis range from $120 per hour (Senior Project Manager) to <br />$220.00 per hour (Principal). <br />FISCAL IMPACT: <br />There are sufficient funds in the Department's professional services budget to cover the additional <br />work required by the consultant. <br />ENVIRONMENTAL IMPACT: <br />There is no environmental impact for the action requested by the Department. <br />CONFLICT OF INTEREST: <br />Duane Morita Planning and Environmental <br />President/Contact: Duane Morita <br />RECOMMENDATION: <br />Staff recommends that the City Council approve a Professional Services Agreement in the <br />amount of Fifty Thousand Dollars ($50,000.00) with Duane Morita for the Preparation of CEQA <br />Documentation (Environmental Assessments/Initial Studies); and authorize the Mayor to execute <br />the Agreement on behalf of the City. <br />Attachment: Professional Services Agreement with Duane Morita <br />Prepared by: Andres Soto, Planning Manager <br />REVIEW TEAM ONLY <br />City Attorney: Finance Director: <br />City Manager: OTHER: <br />
