ITEM #1 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF November 20, 2007 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: DAVID ZAMORA, COMMUNITY DEVELOPMENT DIRECTOR <br />SUBJECT: SECOND READING OF ORDINANCE TO ADOPT CALIFORNIA <br />UNIFORM CODES <br />DATE: November 13, 2007 <br />BACKGROUND: <br />Every three years the California Building Standards Commission ("BSC") updates the Uniform <br />Codes governing construction practices in the State of California. Affected State agencies <br />review these Codes, amend them, and the BSC adopts the amended codes in the California <br />Administrative Code, Title 24. After the State Code is published, every city and county <br />throughout the State has an opportunity to adopt the Uniform Codes with more stringent local <br />amendments based on local geological, topographical and/or climatic conditions. <br />DISCUSSION/ANALYSIS: <br />Adoption of the Uniform Codes and the local amendments is designed to provide consistency in <br />the application and enforcement of building and housing standards, with a particular emphasis on <br />local needs. If the City Council determines not to adopt the proposed Ordinance, the Uniform <br />Codes without the local amendments addressing the City of Colton's local conditions would apply. <br />Adopting these Uniform Codes without local amendments would restrict the City's ability to <br />enforce safety requirements for life and property based on local conditions and the specific needs <br />of the City of Colton. <br />In order to adopt the latest California Uniform Codes, the City must follow the procedure set forth <br />in Section 50022.3 of the Government Code. After first reading of the Ordinance, a public hearing <br />must be scheduled by the City Council. Notice of the public hearing must be published twice in a <br />local newspaper at least 14 days before the public hearing. The Ordinance may be adopted at <br />the conclusion of the public hearing. <br />The City Council introduced the proposed Ordinance on November 6, 2007, waived further <br />reading, and scheduled the required public hearing for November 20, 2007. All publication and <br />notice requirements have been met for the proposed Ordinance. <br />
