ITEM #16 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF February 19, 2008 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: ERIC FRASER, WATER & WASTEWATER DIRECTOR <br />DEAN DERLETH AND GENE TANAKA, CITY ATTORNEY <br />SUBJECT: ADOPT RESOLUTION TO DECLARE SUPPORT FOR THE <br />FORMATION OF A JOINT POWERS AUTHORITY WITH CITY OF <br />RIALTO, WEST VALLEY WATER DISTRICT AND COUNTY OF SAN <br />BERNARDINO TO ADDRESS PERCHLORATE GROUNDWATER <br />CONTAMINATION IN THE RIALTO COLTON BASIN <br />DATE: February 12, 2008 <br />BACKGROUND: <br />City staff members recently met with representatives from the County of San Bernardino, the City <br />of Rialto, West Valley Water District, and members of the State Senate and State Assembly to <br />discuss how to obtain federal funding to clean up perchlorate groundwater contamination in the <br />Rialto -Colton Basin ("RCB"). To that end, the County has invited Colton, Rialto and the West <br />Valley Water District to form a Joint Powers Authority ("JPA") and has requested approval of a <br />supporting resolution and letter. <br />DISCUSSION/ANALYSIS: <br />There are important reasons to support the formation of a JPA: <br />(1) Forming a JPA will help the member agencies obtain federal funding. <br />(2) Cooperating with the JPA members may also help Colton address the impacts of <br />contamination on its water supply. <br />Supporting the resolution does not in and of itself obligate the City to form or participate in the <br />JPA. Rather, it declares the City's support to pursue the formation of a JPA, with the details to be <br />established by the JPA documents. <br />ALTERNATIVES: <br />Alternatively, the City could decline to enter into the JPA. However, if the City chooses not to join <br />the JPA, the City will likely not obtain any federal funds for cleaning up the RCB. <br />
