2601 et seq.]; the Hazardous Materials Transportation Act ("HMTA") [49 U.S.C. Section 1801
<br />et seq.]; the Insecticide, Fungicide, Rodenticide Act [7 U.S.C. Section 6901 et seq.] the Clean
<br />Air Act [42 U.S.C. Section 7401 et seq.]; the Safe Drinking Water Act [42 U.S.C. Section 300f
<br />et seq.]; the Solid Waste Disposal Act [42 U.S.C. Section 6901 et seq.]; the Surface Mining
<br />Control and Reclamation Act [30 U.S.C. Section 101 et seq.]; the Emergency Planning and
<br />Community Right to Know Act [42 U.S.C. Section 11001 et seq.]; the Occupational Safety and
<br />Health Act [29 U.S.C. Section 655 and 657]; the California Underground Storage of Hazardous
<br />Substances Act [Health and Safety Code Section 25280 et seq.]; the California Hazardous
<br />Substances Account Act [Health and Safety Code Section 25300 et seq.]; the California Safe
<br />Drinking Water and Toxic Enforcement Act [Health and Safety Code Section 24249.5 et seq.]
<br />the Porter -Cologne Water Quality Act [Water Code Section 13000 et seq.] together with any
<br />amendments of, or regulations promulgated under the statutes cited above and any other federal,
<br />state, or local law, statute, ordinance, or regulation, now in effect or later enacted, that pertains to
<br />occupational health or industrial hygiene, and only to the extent the occupational health or
<br />industrial hygiene laws, ordinances, or regulations relating to any Hazardous Substance on,
<br />under, or about the Property, or the regulation or protection of the environment, including
<br />ambient air, soil, soil vapor, groundwater, surface water, or land use.
<br />(m) "Environmental Matters" means and refers to any of the following:
<br />(1) The presence of any Hazardous Substance on, in, under, from or
<br />affecting all or any portion of the Mobile Home Park;
<br />(2) The storage, holding, handling, release, threatened release,
<br />discharge, generation, leak, abatement, removal or transportation of any Hazardous Substance
<br />on, in, under, from or affecting the Mobile Home Park;
<br />(3) The violation of any law, rule, regulation, judgment, order, permit,
<br />license, agreement, covenant, restriction, requirement or the like by any of the HOA Parties
<br />relating to or governing in any way Hazardous Substances on, in, under, from or affecting the
<br />Mobile Home Park;
<br />(4) The failure of any of the HOA Parties to properly complete, obtain,
<br />submit and/or file any and all notices, permits, licenses, authorizations, covenants and the like in
<br />connection with their activities at the Mobile Home Park;
<br />(5) The implementation and enforcement by any of the HOA Parties of
<br />any monitoring, notification or other precautionary measures to protect against the release,
<br />potential release or discharge of any Hazardous Substance on, in, under, from or affecting the
<br />Mobile Home Park;
<br />(6) The failure of any of the HOA Parties, in compliance with all
<br />applicable Environmental Laws, to lawfully remove, contain, transport or dispose of any
<br />Hazardous Substance existing, stored or generated on, in, under or from the Mobile Home Park;
<br />(7) Any investigation, inquiry, order, hearing, action or other
<br />proceeding by or before any Governmental Agency in connection with any Hazardous Substance
