APPROVED BY CITYNCIL Date _J, r Item #______ SECOND AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF COLTON AND KRIEGER & STEWART, INC. 1. PARTIES AND DATE, This Second Amendment to the Professional Services Agreement ("Second Amendment") is made and entered into this 16th day of April, 2008 by and between the City of Colton ("City") and Krieger and Stewart, Inc., ("Consultant"). City and Consultant are sometimes individually referred to as "Party" and collectively as "Parties" in this Second Amendment. 2. RECITALS. 2.1 Agreement. City and Consultant entered into that certain Professional Services Agreement dated July 1, 2006 ("Agreement"), whereby Consultant agreed to provide Plan Check services for the new development tract projects. 2.2 Amendment. City and Consultant desire to amend the Agreement for the Second time to increase the compensation to include additional plan check services for the Herzig and Distinguished Homes Developments in an amount not -to -exceed $6,500. 3. TERMS, 3.2 Compensation. Section 3.3.1 of the Agreement is hereby deleted in its entirety and replaced with the following: "3.3.1. Compensation is hereby modified and should read as follows: As consideration for performance of the work required herein, City agrees to pay Consultant the Total Contract Price not to exceed Sixty -Six Thousand Five Hundred Dollars and No Cents (66,500) ("Total Contract Price") provided that such amount shall be sub j ect to adjustment pursuant to the applicable terms of this contract or written change orders approved and signed in advance by the City. 3.3 Continuing Effect Agreement. Except as amended by this Second Amendment, all provisions of the Agreement shall remain unchanged and in full force and effect. From and after the date of this Second Amendment, whenever the term "Agreement" appears in the Agreement, it shall mean the Agreement as amended by this Second Amendment.
