Upon receipt of a completed sign review application by the community development <br />director, the director shall approve, deny, or refer the application to the design review <br />committee within ten calendar days. <br />2. Upon receipt of a completed sign review application by the design review committee, <br />the committee shall approve, deny, or refer the application to the planning <br />commission within twenty calendar days. <br />3. Notwithstanding the time limits imposed by this section, the department and the <br />applicant may mutually agree to an extension of the time limits. Such extension shall <br />be in writing and shall be for no more than ninety days. <br />4. Should the director and/or the committee fail to render a decision on a sign <br />application within the prescribed time limits established by this section, such sign <br />application shall be deemed automatically appealed to the planning commission to the <br />extent it complies with the area and location requirements for signs imposed by this <br />chapter. <br />5. Notwithstanding any of the time limits contained in this section, the community <br />development director and design review committee shall endeavor to render decisions <br />in a timely manner. <br />G. Variances. Applications for a variance from the terms of this title shall be reviewed by <br />the planning commission according to the variance procedures as set forth in this title. <br />H. Appeals. <br />1. Unless otherwise specified herein, a decision of the community development director <br />or design review committee may be appealed by the applicant or any interested person <br />within fifteen days of the decision to the planning commission. The appeal shall be <br />made on the forms prescribed by the planning division and fees shall be paid in <br />accordance with the fee resolution adopted by the city council. Automatic appeals <br />made pursuant to subsection (F)(4) of this section shall not be required to submit a <br />fee. The planning commission shall review an appeal at a regularly scheduled <br />meeting according to the schedule of meetings and deadlines for submission of <br />applications. Notwithstanding such schedule, an appeal hearing shall be held within <br />thirty days of the date of any appeal. <br />2. A decision of the planning commission may be appealed to the city council by the <br />applicant or any interested person in accordance with the provisions of subsection <br />18.58.070(C) of this code. The decision of the city council shall be final. <br />3. A final determination of the city council may be appealed to a court of competent <br />jurisdiction in accordance with applicable provisions of the California Code of Civil <br />Procedure. (Ord. 0-03-02 § 3 (part), 2002) <br />I. Temporary Promotional Sign Permit. <br />1. Permit Requirements and Conditions. No temporary promotional sign shall be <br />displayed without first obtaining a temporary promotional sign permit from the <br />community development director. Permits shall be issued within three working or <br />business days of the filing of a completed application that complies with all provisions <br />of this chapter and the filing of all required fees for a temporary promotional sign. <br />-10- <br />
