Cooperative Agreement No. C08161 <br />under the direction of engineers or architects registered and licensed in the applicable <br />professional field in the State of California. Any engineering reports, and each sheet of plans and <br />specifications for PROJECT shall bear the professional seal, certificate number, registration <br />classification, expiration date certificate, and signature of the professional engineer responsible <br />for their preparation. <br />c) The PS&E phase of the PROJECT shall be performed in accordance with CITY standards. and <br />practices. The construction bid package will be based on the following standards but not be <br />limited to: <br />i) Standard Specifications for Public Works Construction (Greenbook) <br />ii) Standard Plans for Public Works Construction <br />iii) City Standard Specifications <br />iv) City Standard Plans <br />V) Caltrans Bridge Standard Plans and Specifications <br />vi) AASHTO Geometric Design of Highways and Streets and other AASHTO Standards <br />vii) BNSFW RailRoad Standard Plans and Specifications <br />viii) Other applicable standard plans and specifications <br />d) AUTHORITY shall prepare an alternatives feasibility study, also referred to as a Project Report <br />(PR), and to submit it to the CITY for CITY's review and concurrence at appropriate stages of <br />development. The final PR for the PROJECT shall be signed on behalf of AUTHORITY by a <br />Civil Engineer registered in the State of California. The CITY shall approve the final PR. <br />e) The CITY is the California Environmental Quality Act (CEQA) Lead Agency for the PROJECT. <br />Under CEQA, the Lead Agency is the decision-making body and shall make a CEQA <br />Determination on the PROJECT and file the necessary environmental document with the county <br />clerk. <br />i) AUTHORITY agrees it will provide CEQA support as follows: <br />(1) Complete a "Notice of Exemption" for the CITY, if applicable. <br />(2) Prepare an Initial Study, if required. <br />(3) If a Negative Declaration document is applicable: <br />(a) Complete a "Notice of Availability of Negative Declaration" for the CITY. <br />(b) Prepare a final Negative Declaration, including responses to comments from the <br />public <br />(4) If an Environmental Impact Report is applicable: <br />(a) Complete a "Notice of Preparation" for the CITY. <br />(b) Prepare a draft EIR <br />(c) Complete a "Notice of Completion" for the CITY <br />(d) Prepares a final EIR, including responses to comments on the draft EIR <br />(5) Prepare exhibits, handouts, or other material necessary for a Public Hearing <br />ii) CITY, as the CEQA Lead Agency, agrees it will prepare the necessary staff reports and <br />obtain city council decisions or take action on the following: <br />(1) Approve and File a Notice of Exemption with the county clerk, if applicable. <br />(2) Prepare an EIR or a Negative Declaration, if required. <br />(3) If a Negative Declaration (ND) is required: <br />(a) Notify the Public of the availability of a Negative Declaration. <br />c08161.docx 6 of 10 <br />
