CITY OF COLTON <br />AGENDA REPORT ITEM #2 <br />FOR THE COUNCIL MEETING OF August 5, 2008 <br />TO: Honorable Mayor and City Council Members <br />FROM: Bill Smith - Community Services Director <br />SUBJECT: Consider Ordinances & Resolutions Approving Studies of Park <br />Development Impact Fees & Quimby Fees and Amending Park <br />Dedication Requirements & In -lieu Fees and Park Development <br />Impact Fees <br />DATE: July 29, 2008 <br />BACKGROUND: <br />As part of the City Council -approved Community Services Department work plan for fiscal <br />year 2007-08, SCI Consulting Group was contracted to examine current park dedication <br />requirements and park development impact fees for property improvements and development <br />in the City of Colton. These requirements seek to ensure that there is sufficient open space and <br />adequate park improvements in the city to accommodate the parkland needs created by <br />population growth as the result of new development in the city. The consultant has completed <br />its analysis of existing requirements, which have not been updated since 2000, and has found <br />that Colton s requirements are in need of update. <br />DISCUSSION/ANALYSIS: <br />The consultant has completed in-depth studies for both park dedication requirements and park <br />development impact fees. These studies make recommendations for update to the current City <br />Ordinance, and copies of these studies are attached. These studies have been reviewed by both <br />the Planning Commission and the Recreation & Parks Commission. Comments from both of <br />these bodies have been incorporated into the documents. <br />The fee study complies with Government Code Section 66001 by establishing the legal basis for <br />the imposition of park fees, particularly: <br />1. Identifying the purpose of the revised fees (page 14 of the study); <br />2. Identifying the use to which the revised fee is to be put, including identification of <br />any facilities to be financed (page 14 of the study); <br />3. Determining how there is a reasonable relationship between the fee's use and the <br />type of development project on which the fee is imposed (page 15 of the study); <br />4. Determining how there is a reasonable relationship between the need for the public <br />facilities and the type of development project upon which the fees are imposed (page <br />15 of the study); <br />5. Determining how there is a reasonable relationship between the amount of the fee <br />and the cost of the public facilities or portion of the public facility attributable to the <br />development on which the fee is imposed (page 15 of the study). <br />The proposed changes, suggested by the studies, are as follows. <br />1. The city's park dedication requirements should be updated to include the latest <br />housing occupancy factors for accurate calculation of sufficient park dedication. <br />
