Incorporation of Recitals. The Recitals set forth above are <br />true and correct and are incorporated herein by reference. <br />SECTION 2. A112roval of Modified Conditional Use Permits. Based on the <br />entire record before the City Council, all written and oral evidence presented, and the <br />findings made in this Resolution, the City Council hereby modifies the decision of the <br />Planning Commission and modifies the Applications, subject to all prior conditions of <br />approval and the Amended and Restated Conditions of Approval which are attached to <br />this Resolution as Exhibit "A" and incorporated herein and made a part of this <br />Resolution. <br />This modification is to permit the operation of a banquet facility with <br />ancillary alcohol sales and dancing on the Subject Site, subject to the Amended and <br />Restated Conditions of Approval, attached to this Resolution as Exhibit "A". This <br />approval is granted based upon the approved Site Plan submitted as part of DC -51-00, <br />on file with the Colton Community Development Department, except as modified by <br />this approval. Deviations from said Site Plan shall not be permitted without the <br />approval of the Colton Planning Commission. In the event that conditions reflected on <br />the Site Plan are inconsistent with the Amended and Restated Conditions of Approval <br />attached hereto as Exhibit "A", the written conditions shall prevail. <br />SECTION 3. Conditional Use Permit (Modification)Findings. The City <br />Council hereby finds as follows with respect to the modification of the Applications: <br />1. The proposed modification to the use is in accord with the general plan, <br />the objectives of Title 18 of the Colton Municipal Code, and the purposes of the zone in <br />which the Subject Site is located. The proposed modified use is located in an area zoned <br />C-2 (General Commercial). <br />The Subject Site is designated as "General Commercial" in the Colton General <br />Plan. It is located within the C-2 (General Commercial) zoning designation. Modification of the <br />Applications to permit use of the Subject Site as banquet facility with ancillary liquor sales for <br />on-site consumption and dancing permitted via a regulated dance permit are conditionally <br />permitted uses in this zoning designation. This modified conditional use permit has also been <br />conditioned to comply with all applicable requirements of Title 18 of the Colton Municipal Code. <br />2. The proposed modification to the use, together with the conditions <br />applicable thereto will not be detrimental to the public health, safety or welfare, or <br />materially injurious to properties or improvements in the vicinity. <br />-2- <br />
