APPROVED BY CITYC� �IClL Date , `� I �i1_ Item # 1 FIRST AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF COLTON AND TOM DODSON & ASSOCIATES 1. PARTIES AND DATE. THIS FIRST AMENDMENT to the Professional Services Agreement ("First Amendment") is made and entered into this 1 6 day of August, 2008 between the City of Colton ("City") and Tom Dodson & Associates ("Consultant"). City and Consultant are sometimes referred to individually as "Party" and collectively as the "Parties" in this First Amendment. 2. RECITALS. 2.1 Agreement. City and Consultant entered into that certain Professional Services Agreement for preparation of environmental documents pursuant to the California Environmental Quality Act (CEQA) ("Project") on February 20, 2007 ("Agreement"), wherein the Consultant agreed to prepare environmental documents pursuant to CEQA for the SA Recycling LLC (formerly Sims Hugo Neu West) dba Colton Iron & Metal (the "Applicant') Development Application for discretionary land approvals for a Modification to the Conditions of Approval of a Conditional Use Permit (CUP) (Resolution No. 2843) to legalize all unpermitted improvements made to an established salvage scrap iron yard (the "Facility") on approximately 3.5 acres at 790 East "M" Street, including an expansion/addition to the previously approved Facility ("Addition to Facility"). 2.2 Amendment. City and Consultant desire to amend the Agreement to authorize a budget augmentation of fourteen thousand five hundred dollars ($14,500) to pay for Consultant costs to address changes in the scope of the project and to address additional work to compile an adequate draft Initial Study consisting of a Public Health Risk Assessment, Biological Resources Survey, Cultural Resources Survey, Phase II Assessment, Revised Noise Evaluation, a Traffic Study, and a Drainage and Water Quality Evaluation. 3. TERMS. 3.1. Scope of Services. Section 3. 1.1 of the Agreement is hereby deleted in its entirety and replaced with the following: "3.1.1 General Scope of Services. Consultant promises and agrees to furnish to the City all labor, materials, tools, equipment, services, and incidental and customary work necessary to fully and adequately supply the professional environmental consulting services necessary for the Project ("Services").
