PARTIES AND DATE. <br />THIS FIRST AMENDMENT to the Professional Services Agreement ("First Amendment") <br />is made and entered into this 1 6 day of August, 2008 between the City of Colton ("City") and <br />Tom Dodson & Associates ("Consultant"). City and Consultant are sometimes referred to <br />individually as "Party" and collectively as the "Parties" in this First Amendment. <br />2. RECITALS. <br />2.1 Agreement. City and Consultant entered into that certain Professional Services <br />Agreement for preparation of environmental documents pursuant to the California Environmental <br />Quality Act (CEQA) ("Project") on February 20, 2007 ("Agreement"), wherein the Consultant agreed <br />to prepare environmental documents pursuant to CEQA for the SA Recycling LLC (formerly Sims <br />Hugo Neu West) dba Colton Iron & Metal (the "Applicant') Development Application for <br />discretionary land approvals for a Modification to the Conditions of Approval of a Conditional Use <br />Permit (CUP) (Resolution No. 2843) to legalize all unpermitted improvements made to an <br />established salvage scrap iron yard (the "Facility") on approximately 3.5 acres at 790 East "M" <br />Street, including an expansion/addition to the previously approved Facility ("Addition to Facility"). <br />2.2 Amendment. City and Consultant desire to amend the Agreement to authorize a <br />budget augmentation of fourteen thousand five hundred dollars ($14,500) to pay for Consultant costs <br />to address changes in the scope of the project and to address additional work to compile an adequate <br />draft Initial Study consisting of a Public Health Risk Assessment, Biological Resources Survey, <br />Cultural Resources Survey, Phase II Assessment, Revised Noise Evaluation, a Traffic Study, and a <br />Drainage and Water Quality Evaluation. <br />3. TERMS. <br />3.1. Scope of Services. Section 3. 1.1 of the Agreement is hereby deleted in its entirety <br />and replaced with the following: <br />"3.1.1 General Scope of Services. Consultant promises and agrees to furnish to the <br />City all labor, materials, tools, equipment, services, and incidental and customary <br />work necessary to fully and adequately supply the professional environmental <br />consulting services necessary for the Project ("Services").
