particularly described on plan # 7645, located in the Water and Wastewater Department, CITY <br />of Colton: and <br />WHEREAS, as a condition to the further development of DEVELOPER's Property, <br />CITY has required DEVELOPER to construct and install 480 feet of water line to serve <br />DEVELOPER's Property (the "Improvements"). The Improvements are described in more detail <br />in Exhibit `B" attached hereto. <br />WHEREAS, the Improvements will benefit others than the Developer in the future, and <br />shall be dedicated to the public by the Developer upon completion and acceptance by the CITY; <br />and <br />WHEREAS, Resolution No. 3805 of the CITY of Colton authorizes the CITY to enter <br />into reimbursement agreements with DEVELOPERS and/or individuals who install water or <br />sewer lines which benefit others: and <br />WHEREAS, DEVELOPER is willing to advance the costs of constructing and installing <br />the Facility(ies) subject to reimbursement from subsequent property owners to the extent that <br />such other properties outside of DEVELOPER's Property benefit from the Facility(ies) (the <br />"Benefiting Properties" shown in Exhibit "C" attached hereto; and <br />WHEREAS, DEVELOPER shall submit contracts, invoices and proof of payment for the <br />water line installation substantiating the cost per lineal foot. <br />NOW, THEREFORE, the parties hereto agree as follows: <br />TERMS. <br />1. Design and Construction of Improvements. DEVELOPER shall be solely <br />responsible for constructing and installing the Improvements. The Improvements shall be fully <br />completed and ready for acceptance by CITY on November 1, 2008.
