ITEM #6 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF APRIL 21, 2009 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: MARITZA TAPIA, INTERIM PUBLIC WORKS DIRECTOR <br />SUBJECT: AUTHORIZE EXECUTION OF A DELEGATE AGENCY AGREEMENT <br />WITH THE COUNTY OF SAN BERNARDINO FOR FISCAL YEARS <br />2009-2010, 2010-2011, and 2011-2012. <br />DATE: April 13, 2009 <br />BACKGROUND: <br />On June 2, 2008, Council authorized execution of a Three Year Cooperation Agreement for fiscal <br />years 2009-2010, 2010-2011 and 2011-2012; this agreement was entered into between the City of <br />Colton and the San Bernardino County Department of Economic Community Development (ECD). <br />The purpose of the agreement was to continue Colton's participation in the County's Consolidated <br />Submission of the HUD Housing and Community Development Grant programs (Consolidated <br />Plan). The Three Year Cooperation Agreement, extended the City's participation with the County <br />in the following federal programs: CDBG, HOME, and ESG. Colton is one of twelve cities which <br />have cooperative agreements with ECD. <br />DISCUSSION/ANALYSIS: <br />In addition, to the Three Year Cooperation Agreement all participating cities with the County must <br />also enter into a Delegate Agency Agreement. The Three Year Cooperation Agreement allows the <br />City to participate in the Urban County CDBG County Program as a joint applicant, whereas the <br />Delegate Agency Agreement authorizes the County to implement the provisions of the Three Year <br />Cooperation Agreement while carrying out CDBG activities approved by the County for the City. <br />The Delegate Agency Agreement identifies the proper procedures City must abide by for <br />development of approved CDBG Projects, identifying approval steps needed to move a project <br />through the needed administrative approvals to ensure reimbursement. Staff recommends <br />approval of the Delegate Agency Agreement, attached as Exhibit A. <br />FINANCIAL IMPACT: <br />The County has requested that four (4) executed agreements be returned to continue participation <br />with the County in the CDBG Program. It is estimated that the City will receive <br />approximately $418,654 in CDBG funds for fiscal year 2009-2010. <br />ENVIRONMENTAL IMPACT: <br />This action will not have any environmental impacts, however all CDBG funded projects require <br />compliance with Federal and State environmental procedures prior to implementation. <br />CONFLICT OF INTEREST — Gift Disclosure Requirements <br />None. <br />
