City Council Meeting — May 5, 2009 <br />Deferral of Conditions of Approval—Piano Empire, Inc. <br />Page 2 of 2 <br />terms and conditions set forth in the Agreement. <br />Approval of the Agreement allows the Applicant to use the property and receive income on a <br />temporary basis until there is development interest in implementing the West Valley Specific Plan. <br />Staff and the Design Review Committee support the Applicant's proposal to use the property on a <br />temporary basis. <br />ALTERNATIVES: <br />1. Reject the Deferred Improvement Agreement with Piano Empire, Inc, and process the <br />Development Application waiving the Conditions of Approval to make improvements to the <br />property. <br />FISCAL IMPACT: <br />Minimal positive impact; use of the property requires the Applicant to obtain a Business <br />Occupancy Permit, City Business License, and pay any business license tax to the City General <br />Fund based on gross annual revenue. <br />ENVIRONMENTAL IMPACT: <br />None, the Design Review Committee approved a Notice of Exemption for the proposed project. <br />RECOMMENDATION: <br />Staff recommends that the City Council approve the Deferral of Conditions of Approval Agreement <br />between the City of Colton and Piano Empire, Inc, and authorize the City Manager to execute the <br />Agreement on behalf of the City. <br />Attachment: Deferral of Conditions of Approval Agreement <br />REVIEW TEAM ONLY <br />City Attorney: <br />Finance Director: <br />City Manager: rV OTHER: <br />
