DISCUSSION/ANALYSIS: <br />The Electric Utility desires to continue with the Evaporative Cooler Program and purchase 200 each of <br />the Bonaire/Vail portable evaporative cooler at $216.91 per unit, and 200 plastic buckets at a cost of <br />$3.50each, sales tax included, from The Home Depot, Inc. In addition to the portable evaporate coolers, <br />The Electric Utility desires to purchase 100 each 20" box fans to provide to qualified customers as part of <br />the program. The coolers will cost $16.34 each, including sales tax. The delivery charges will be an <br />additional $158.00, for a total purchase price of $45,873.69. <br />Colton Municipal Code, Title 3, Chapter 3.08.140, Section (b) allows for the competitive bidding <br />requirement, either formal or informal, to be waived for non-public projects, when there is no competitive <br />market. Specifically, Section (b) states, "When the City Council determines, in accordance with <br />applicable law, that a competitive market does not exist and that no competitive advantage will be gained <br />by the public bidding process". In addition, Municipal Code 3.08.140 Section (e) also states in part, <br />"When the City Manager determines that it is in the best interest of the City and its administrative <br />operations to dispense with public bidding for non-public projects under this chapter." Staff confirmed <br />through the manufacturer, that we cannot purchase these units elsewhere.
