ANALYSIS/DISCUSSION: <br />Colton has several federally funded or assisted CIP projects scheduled for 2009-2010. Some of <br />these funding sources include: Community Development Block Grant (CDBG) projects, Air Quality <br />Congestion Mitigation & Air Quality (CMAQ) Improvement Program projects, and Transportation <br />Equity Act for the 21st Century (TEA -21) projects. In order to remain eligible for federal funding, <br />the City is required to execute a Race-Conscious/Race-Neutral DBE Implementation Agreement <br />with Caltrans on or before June 2, 2009. By executing said agreement, Exhibit A, the City is <br />acknowledging its commitment to implement the Caltrans Race Conscious/Race Neutral DBE <br />Program Plan and to comply with all the requirements on federal -aid projects. <br />As part of the DBE Implementation Agreement (Exhibit A), City is required to submit an Annual <br />DBE Submittal Form (Exhibit B) by June 1St of each year, for the following Federal Fiscal Year <br />(FFY). The Annual Submittal Form includes: Annual Anticipated DBE Participation Level <br />(AADPL), methodology for establishing City's AADPL, and the designated DBE Liaison Officer. <br />Staff requests Council authorize the Public Works Director to execute the DBE Implementation <br />Agreement and all related documents needed to comply with the Caltrans administered DBE <br />Program. <br />CONFLICT OF INTEREST <br />None. <br />ENVIRONMENTAL IMPACT <br />There is no environmental impact for this action. <br />FINANCIAL/FISCAL IMPACT <br />There is no Fiscal impact associated with this recommendation. Public notice is not required for the <br />established AADPL. <br />RECOMMENDATION: <br />Staff respectfully recommends that City Council: <br />• Approve execution of the Disadvantage Business Enterprise (DBE) Implementation <br />Agreement with Caltrans. <br />• Adopt a Resolution authorizing the Public Works Director to execute the Agreement <br />and any subsequent amendments, and other documents required by Caltrans for City's <br />DBE Program such as Local Agency DBE Annual Submittal Form. <br />
