ANALYSIS/DISCUSSION: Colton has several federally funded or assisted CIP projects scheduled for 2009-2010. Some of these funding sources include: Community Development Block Grant (CDBG) projects, Air Quality Congestion Mitigation & Air Quality (CMAQ) Improvement Program projects, and Transportation Equity Act for the 21st Century (TEA -21) projects. In order to remain eligible for federal funding, the City is required to execute a Race-Conscious/Race-Neutral DBE Implementation Agreement with Caltrans on or before June 2, 2009. By executing said agreement, Exhibit A, the City is acknowledging its commitment to implement the Caltrans Race Conscious/Race Neutral DBE Program Plan and to comply with all the requirements on federal -aid projects. As part of the DBE Implementation Agreement (Exhibit A), City is required to submit an Annual DBE Submittal Form (Exhibit B) by June 1St of each year, for the following Federal Fiscal Year (FFY). The Annual Submittal Form includes: Annual Anticipated DBE Participation Level (AADPL), methodology for establishing City's AADPL, and the designated DBE Liaison Officer. Staff requests Council authorize the Public Works Director to execute the DBE Implementation Agreement and all related documents needed to comply with the Caltrans administered DBE Program. CONFLICT OF INTEREST None. ENVIRONMENTAL IMPACT There is no environmental impact for this action. FINANCIAL/FISCAL IMPACT There is no Fiscal impact associated with this recommendation. Public notice is not required for the established AADPL. RECOMMENDATION: Staff respectfully recommends that City Council: • Approve execution of the Disadvantage Business Enterprise (DBE) Implementation Agreement with Caltrans. • Adopt a Resolution authorizing the Public Works Director to execute the Agreement and any subsequent amendments, and other documents required by Caltrans for City's DBE Program such as Local Agency DBE Annual Submittal Form.
