award a subsequent contract to the same individual or entity for the same or similar services, or <br />amend, extend or renew such a contract, without City Council approval, when the award, <br />amendment, extension or renewal will result in the City paying an aggregate amount of more than <br />twenty-five thousand dollars ($25,000) to the individual entity in any given fiscal year. Therefore, <br />Council action is needed for these contracts. <br />In addition, CMC Section 3.08.140 provides that the City Manager, for contracts up to $100,000, <br />may dispense with public bidding for Professional Services Agreements when it is in the best <br />interests of the City and its administrative operations. Criterion Automation is very familiar with the <br />process control hardware and interface of the City's SCADA Systems and has been working with <br />the Department in prior fiscal years to upgrade and repair the system on an as -needed basis. <br />Therefore, City staff respectfully requests that the Colton Utility Authority authorize the City <br />Manager to amend the existing agreement with Criterion Automation for an additional $20,000 <br />resulting in a total agreement amount not -to -exceed $55,000 and to extend the term of the <br />agreement through June 30, 2010. The aggregate of contracts awarded to Criterion Automation <br />for both contracts would be $99,550. <br />FINANCIAL IMPACT: <br />Funds are available for this project. The Account Number to be used is 522-8200-8200-2350- <br />0000-000.
