1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16' <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the economic decline, coupled with the passage of the Governor's <br />proposal to fund and balance the state budget by seizure of City's Highway Users Tax Account <br />(HUTA), also known as local "gas tax", this would critically jeopardize the City of Colton's <br />ability to maintain local streets, bridges, traffic signals, streetlights, sidewalks and operations <br />of public facilities and related services, as well as public safety services. <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON hereby <br />directs the City Attorney to take all necessary steps to cooperate with the League of California <br />Cities, other cities and counties in supporting litigation against the state of California if the <br />legislative enacts and the Governor signs the Highway Users Tax Account (HUTA), also <br />known as the "gas tax," to fund the state general fund; <br />RESOLVED FURTHER, that the Colton City Manager shall send this resolution with <br />an accompanying letter from the Mayor to the Governor and each legislator, informing them in <br />the clearest of terms of the City's adamant resolve to oppose any effort to frustrate the will of <br />the electorate as expressed in Proposition 5 (1974) and Proposition 8 (1998) concerning the <br />proper use and allocation of the gas tax; <br />RESOLVED FURTHER, that a copy of this Resolution shall be sent by the City <br />Manager to the League of California Cities, the Colton Chamber of Commerce, and other <br />community groups whose members are affected by this proposal to create unsafe conditions on <br />the streets of our City for pedestrians, bicyclists and motorist. <br />PASSED, APPROVED AND ADOPTED this 23rd day of June, 2009. <br />KELLY J.
