The Supervisory Control and Data Acquisition (SCADA) are used by both Water and Wastewater <br />Divisions, but they are paid out of two different departmental funds; therefore, they are considered <br />separate projects due to the SCADA supporting two different systems. On June 2, 2009 Council <br />approved an amendment to the Wastewater Department's contract to Criterion Automation to add <br />additional funds in an amount not -to -exceed $20,000. The Water Department is requesting a <br />contract with Criterion Automation in an amount not -to -exceed $25,000 for the Water's SCADA <br />System. <br />The City's Purchasing Policy for Professional Services (CMC Section 3.08.070 (g)) states the City <br />Manager shall not award a subsequent contract to the same individual or entity for the same or <br />similar services, or amend, extend or renew such a contract, without City Council approval, when <br />the award, amendment, extension or renewal will result in the City paying an aggregate amount of <br />more than twenty-five thousand dollars ($25,000) to the individual entity in any given fiscal year. <br />Therefore, Council action is needed for these contracts. <br />In addition, CMC Section 3.08.140 provides that the City Manager, for contracts up to $100,000, <br />may dispense with public bidding for Professional Services Agreements when it is in the best <br />interests of the City and its administrative operations. Criterion Automation is very familiar with the <br />process control hardware and interface of the City's SCADA Systems and has been working with <br />the Department in prior fiscal years to upgrade and repair the system on an as -needed basis. <br />Therefore, City staff respectfully requests that City Council ratify the City Manager's waiver of <br />competitive bidding, and approve and award the Professional Services contract to Criterion <br />Automation in an amount not -to -exceed $25,000 for the Water's on-going SCADA System <br />retrofit/upgrade services. The aggregate amount awarded to Criterion Automation between water <br />and wastewater would be $45,000. <br />FINANCIAL IMPACT: <br />Funds are available for this project.
