2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ITEM #4 <br />ORDINANCE NO. 0-05-09 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON AMENDING CHAPTER 2.12 OF THE COLTON <br />MUNICIPAL CODE TO REDUCE COUNCIL MEMBER SALARIES <br />FOR THE 2009-10 FISCAL YEAR <br />WHEREAS, California Government Code section 36516 provides a method by which <br />salaries for members of a city council may be established and adjusted; and <br />WHEREAS, Section 36516 states that a city council may enact an ordinance providing <br />that each member of the city council shall receive a salary in an amount not to exceed statutory <br />limits; and <br />WHEREAS, in 1988, the City Council enacted Ordinance No. 0-24-88, which amended <br />section 2.12.030 of Chapter 2.12 of the Colton Municipal Code to state that each City Council <br />Member is to receive a salary of four hundred dollars ($400) each month; and <br />WHEREAS, the City and the State of California are currently experiencing difficult <br />economic times which have resulted in many City employees agreeing to take, on average, a <br />two percent (2%) reduction in salary; and <br />WHEREAS, in light of the City's current economic difficulties, the City Council wishes to <br />amend Section 2.12.030 of the Colton Municipal Code and reduce the monthly salary of the City <br />Council by five percent (5%) for the 2009/2010 fiscal year. <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION 1. Amendment. Section 2.12.030 of Chapter 2.12 of Title 2 of the Colton <br />Municipal Code is hereby deleted in its entirety and restated to read as follows: <br />"2.12.030 City councilmembers. <br />The salary of each member of the city council is fixed at four <br />hundred dollars ($400) per month; provided, however, that <br />beginning for the September 2009 pay period, the salary shall be <br />three hundred and eighty dollars ($380) per month for the <br />2009/2010 fiscal year. In addition, the City Council may, by <br />resolution, extend this temporary reduction for any amount of time <br />it chooses." <br />SECTION 2. Severability. If any section, subsection, subdivision, sentence, clause, <br />phrase, or portion of this Ordinance for any reason is held to be invalid or unconstitutional by the <br />decision of any court of competent jurisdiction, such decision shall not affect the validity of the <br />remaining portions of this Ordinance. The City Council hereby declares that it would have <br />adopted this Ordinance and each section, subsection, subdivision, sentence, clause, phrase, or <br />portion thereof, irrespective of the fact that any one or more sections, subdivisions, sentences, <br />clauses, phrases, or portions thereof be declared invalid or unconstitutional. <br />ONTARIO\NSTUBBS\305035.3 - 1 - <br />
