Jones & Mayer Contract Amendment <br />November 3, 2009 Council Agenda Report <br />Page 2 of 3 <br />Section E of Chapter 3.08.140 (Exceptions to competitive bidding—Non-public projects) of the <br />Colton Municipal Code states: <br />"In addition to the situations described in Sections 3.08.060 through 3.08.080, <br />competitive bidding, either formal or informal, is not required for non-public projects in <br />the situations provided for in this section. Under such conditions, any alternative <br />procedure, including no bidding, may be used with the city manager's approval." <br />Section E continues to say: <br />"E. Purpose of Bidding is Otherwise Accomplished. When the city manager determines <br />that it is in the best interest of the city and its administrative operations to dispense with <br />public bidding for non-public projects under this chapter. Prior city council concurrence <br />with the city manager's determination shall be required for non-public project purchases <br />over one hundred thousand dollars." <br />In this case, it's in the City's best interest to keep using Jones Mayer for this appeal because <br />they're already familiar with the background of the case. Going back out to bid for these services <br />would cause additional cost and pose severe time restraints to the City in ensuring a timely <br />appeal before the City Council <br />FINANCIAL IMPACT: <br />The total cost of this contract through the appeal to the City Council is estimated to be <br />approximately $23,500. These costs include the roughly $19,500 that were required to support the <br />hearing through the Planning Commission. Staff is recommending a 15% contingency be <br />authorized for this effort in the event that actions related to the appeal to the City Council exceed <br />the current estimate.
