VII. An EIR Addendum is the Proper Method to Address the Court's Concerns <br />The City finds that none of the conditions described in CEQA Guidelines <br />Section 15162 or Section 15163 requiring the preparation of a Subsequent or a <br />supplement to an EIR have occurred. Specifically, the City has determined the <br />following: <br />No Substantial Change in the Project. There are no substantial changes in the <br />Project. Rather, there are simple clarifications of the Project's traffic impacts. There are <br />no new significant environmental effects or any substantial increases in the severity of <br />previously identified significant effects. No major revisions to the EIR are required. The <br />EIR's mitigation measures will continue to be more than adequate to mitigate the <br />Project's traffic impacts. <br />No Substantial Changes in Circumstances. There are no substantial changes with <br />respect to the circumstances under which the Project is undertaken which will require <br />major revisions to the EIR due to the involvement of new significant environmental <br />effects or a substantial increase in the severity of previously identified significant effects. <br />The clarifications provided herein will not result in new or substantially increased <br />environmental effects resulting from the Project. <br />No New Information of Substantial Importance. There is no new information of <br />substantial importance, which was not known and could not have been known with the <br />exercise of reasonable diligence at the time the EIR was certified as complete which <br />shows that the Project will have one or more significant effects or substantially more <br />severe effects not discussed in the EIR. Except for the new information regarding the <br />status of Tier 4 of the SANBAG Valley Signal Synchronization Program, the Project and <br />its traffic impacts all remain the same as contemplated in the EIR. There are no <br />mitigation measures or alternatives previously found not to be feasible that would now in <br />fact be feasible and would substantially reduce one or more significant effects of the <br />Project. Additionally, there are no mitigation measures or alternatives which are <br />considerably different from those analyzed in the EIR which would substantially reduce <br />the environmental effects related the Project's traffic. Consequently, there is no new <br />information indicating that new significant or substantially more severe environmental <br />effects would result from the Project's traffic. <br />No Conditions Requiring a Supplement to an EIR. A supplement to an EIR may <br />be prepared if a Subsequent EIR is required and only minor additions or changes would <br />be necessary. Given that none of the conditions requiring a Subsequent EIR are <br />triggered, a supplement to an EIR is not appropriate. <br />wc-141612 11 <br />
